First Substitute H.B. 85

Representative Glenn L. Way proposes the following substitute bill:

             6      This act creates the Water Development and Conservation Task Force. The act provides for
             7      membership of the task force and compensation of members. The act outlines the
             8      responsibilities and duties of the task force. The act provides for reports to various
             9      legislative committees. The act appropriates $29,500 from the General Fund for fiscal year
             10      2001-02. The act provides for staffing of the task force. The act is repealed November 30,
             11      2003.
             12      This act enacts uncodified material.
             13      Be it enacted by the Legislature of the state of Utah:
             14          Section 1. Water Development and Conservation Task Force -- Creation --
             15      Membership -- Interim rules followed -- Compensation -- Staff.
             16          (1) There is created the Water Development and Conservation Task Force consisting of
             17      the following 12 members:
             18          (a) five members of the Senate appointed by the president of the Senate, no more than
             19      three of whom may be from the same political party; and
             20          (b) seven members of the House of Representatives appointed by the speaker of the House
             21      of Representatives, no more than four of whom may be from the same political party.
             22          (2) (a) The president of the Senate shall designate a member of the Senate appointed under
             23      Subsection (1)(a) as a cochair of the committee.
             24          (b) The speaker of the House of Representatives shall designate a member of the House
             25      of Representatives appointed under Subsection (1)(b) as a cochair of the committee.


             26          (3) In conducting its business, the committee shall comply with the rules of legislative
             27      interim committees.
             28          (4) Salaries and expenses of the members of the committee shall be paid in accordance
             29      with Section 36-2-2 and Legislative Joint Rule 15.03.
             30          (5) The Office of Legislative Research and General Counsel shall provide staff support to
             31      the committee.
             32          Section 2. Duties -- Interim report.
             33          (1) The committee shall review and make recommendations on the following issues:
             34          (a) all issues the task force determines to be appropriate relating to water conservation
             35      policies and practices in the state, including:
             36          (i) water reclamation;
             37          (ii) methods of paying for water provided to water users and whether using property taxes
             38      to pay for some or all of the cost of providing water encourages or discourages water conservation;
             39          (iii) the financing of facilities that gather, store, and transport water;
             40          (iv) the reuse and ownership of effluent from wastewater treatment plants;
             41          (v) policies and practices of other states throughout the country that have been successful
             42      in encouraging and achieving water conservation;
             43          (b) the feasibility of creating a lake authority for the management and development of Utah
             44      Lake;
             45          (c) possible funding source for a Utah Lake Authority other than general tax revenues,
             46      including fees on property that would be enhanced by the development of the lake and fees from
             47      additional water capacity in the lake;
             48          (d) the feasibility and effects of dredging portions of Utah Lake and creating islands in the
             49      lake;
             50          (e) the construction of a causeway across Utah Lake and potential funding sources for the
             51      causeway, including the collection of tolls;
             52          (f) the potential economic development benefits of improvements to Utah Lake; and
             53          (g) the potential for increased water storage and conservation in Utah Lake.
             54          (2) A final report, including any proposed legislation shall be presented before November
             55      30, 2003, to the:
             56          (a) Natural Resources, Agriculture, and Environment Interim Committee;


             57          (b) Revenue and Taxation Interim Committee;
             58          (c) Workforce Services and Economic Development Interim Committee; and
             59          (d) Legislative Management Committee.
             60          Section 3. Appropriation.
             61          There is appropriated from the General Fund for fiscal year 2001-02, an appropriation of:
             62          (1) $6,000 to the Senate to pay for the compensation and expenses of senators on the
             63      committee;
             64          (2) $8,500 to the House of Representatives to pay for the compensation and expenses of
             65      representatives on the committee; and
             66          (3) $15,000 to the Office of Legislative Research and General Counsel to pay for staffing
             67      the committee.
             68          Section 4. Repeal date.
             69          This act is repealed November 30, 2003.
