5 This act modifies the Criminal Code regarding the aggravated robbery offense of
6 "carjacking" to provide that the attempt to take or "carjack" a motor vehicle is also an
7 aggravated robbery offense.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 AMENDS:
10 76-6-302, as last amended by Chapter 271, Laws of Utah 1994
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 76-6-302 is amended to read:
13 76-6-302. Aggravated robbery.
14 (1) A person commits aggravated robbery if in the course of committing robbery, he:
15 (a) uses or threatens to use a dangerous weapon as defined in Section 76-1-601 ;
16 (b) causes serious bodily injury upon another; or
17 (c) takes or attempts to take an operable motor vehicle.
18 (2) Aggravated robbery is a first degree felony.
19 (3) For the purposes of this part, an act shall be considered to be "in the course of
20 committing a robbery" if it occurs in an attempt to commit, during the commission of, or in the
21 immediate flight after the attempt or commission of a robbery.
