Chair Murray called the meeting to order at 8:10 a.m.

MOTION:    Representative Clark moved to approve the minutes of the January 30, 2003 committee meeting. The motion passed unanimously with Representative Bush, Representative Dunnigan, and Representative McCartney absent for the vote.


H.B. 84    Child Restraint Safety Devices (C. Moss)

Representative Moss explained the bill to the committee with the assistance of Janet B. Brooks, Child Advocacy Manager - Primary Children's Medical Center. James Cosgrove, age 7, assisted in a demonstration of proper seating of children in child restraint safety seats. Handouts were distributed to committee members.

Dr. Howard M. Corneli, Pediatrician - Primary Children's Medical Center; Katie Gregory, Utah Children; and Rolayne Fairclough, AAA Utah, spoke in support of the bill.

Krystin Morley, homemaker, and Gayle Ruzicka, Utah Eagle Forum, spoke in opposition to the bill.



MOTION:
    Representative King moved to pass the bill out favorably. The motion failed with the voting as follows: Representative Bird, Representative Bush, Representative Clark, Representative Dougall, Representative Dunnigan, and Representative Kiser voted no. Representative King, Representative McCartney, Representative Morgan, and Representative Murray voted yes.

Chair Murray relinquished the chair to Representative King.


S.B. 16    Master State Highways Amendments (D. Steele)

Representative Murray explained the bill to the committee.

MOTION:    Representative McCartney moved to pass the bill out favorably. The motion passed unanimously with Representative Bush absent for the vote.

MOTION:    Representative Dunnigan moved to place the bill on the Consent Calendar. The motion passed unanimously with Representative Bush absent for the vote.

Chair Murray resumed the chair.


S.B. 79S1    Disabled Parking Fine (D. C. Buttars)

Senator Buttars presented the bill to the committee with proposed amendments.

MOTION:    Representative King moved to amend the bill as follows:

1.    Page 3, Line 69
Senate 3rd Reading Amendments
1-28-2003:    Delete "Subsection" and insert "Section"

2.    Page 3, Line 70
Senate 3rd Reading Amendments
1-28-2003:    Delete ", minus the court costs,"

3.     Page 4, Lines 95-100
Senate 3rd Reading Amendments
1-28-2003:    Delete lines 95-100 and insert
        "(6) The fine collected under Section 41-1a-306 for a violation of the parking privileges for persons with disabilities shall be paid:
        (a) 50% to the state treasurer to be deposited in the "Out and About" Homebound Transportation Assistance Fund created in Section 62A-3-110; and
        (b) 50% in accordance with Subsection (1).
"



    The motion passed unanimously.

Senator Buttars explained the bill to the committee.

Fraser Nelson, Disability Law Center; Joyce L. Dolcourt, Arc of Utah; and Stephen Unopulos spoke in support of the bill.

MOTION:    Representative Bird moved to pass the bill out favorably as amended. The motion passed with Representative Dunnigan voting no. Representative Morgan was absent for the vote.

MOTION:    Representative McCartney moved to adjourn the meeting. The motion passed unanimously with Representative Morgan absent for the vote.

Chair Murray adjourned the meeting at 9:46 a.m.
