7 LONG TITLE
8 General Description:
9 This bill modifies the Utah State Retirement and Insurance Benefit Act by amending
10 membership eligibility provisions of the Public Employees' Benefit and Insurance
11 Program Act.
12 Highlighted Provisions:
13 This bill:
14 . allows a zoological society to participate in public employees' benefit and insurance
15 program in certain circumstances.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 49-20-201 is amended to read:
26 49-20-201. Program participation -- Eligibility -- Optional for certain groups.
27 (1) (a) The state shall participate in the program on behalf of its employees.
28 (b) Other employers, including political subdivisions and educational institutions, are
29 eligible, but are not required, to participate in the program on behalf of their employees.
30 (c) A zoological society is eligible, but is not required to participate in the program on
31 behalf of its employees if the zoological society:
32 (i) is a participating employer in the Public Employees' Noncontributory Retirement
33 System under Title 49, Chapter 13, Public Employees' Noncontributory Retirement Act as of
34 January 1, 2004; and
35 (ii) receives a majority of its funding contributions from state and local government
36 sources.
37 (2) (a) The Department of Health may participate in the program for the purpose of
38 providing health and dental benefits to children enrolled in the Utah Children's Health
39 Insurance Program created in Title 26, Chapter 40, Utah Children's Health Insurance Act, if the
40 provisions in Subsection 26-40-110 (4) occur.
41 (b) If the Department of Health participates in the program under the provisions of this
42 Subsection (2), all insurance risk associated with the Children's Health Insurance Program shall
43 be the responsibility of the Department of Health and not the program or the office.
44 (3) A covered individual covered under a medical employee benefit plan shall be
45 eligible for coverage after termination of employment under rules adopted by the board.
46 (4) Only retirees, members, participants, and their current spouses are eligible for
47 Medicare supplement coverage under this chapter upon becoming eligible for Medicare Part A
48 and Part B coverage.
49 Section 2. Effective date.
50 This bill takes effect on July 1, 2004.
