8 General Description:
9 This bill creates the Conservation Easement Monitoring Endowment Account.
10 Highlighted Provisions:
11 This bill:
12 . creates within the General Fund a restricted account consisting of grants and
13 donations from foundations, the Quality Growth Commission, the state and federal
14 governments, and landowners; and
15 . specifies that the fund is to be used to monitor or assist in the maintenance of
16 conservation easements held by the Department of Natural Resources S. and the Department of
16a Agriculture and Food .S .

25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 63-34-20 is enacted to read:

27 63-34-20. Conservation easement monitoring endowment restricted account.

(1) There is created within the General Fund a restricted account known as the
29 Conservation Easement Monitoring Endowment Account.
30 (2) The Conservation Easement Monitoring Endowment Account consists of:
31 (a) grants from private foundations;
32 (b) grants from the state or federal government;
33 (c) grants from the Quality Growth Commission created under Section 11-38-201 ;
34 (d) donations from landowners provided for the purpose of monitoring or assisting in
35 the maintenance of conservation easements;
36 (e) donations from any other person; and
37 (f) interest on account monies.
38 (3) Upon appropriation by the Legislature, monies from the account shall be used to
39 monitor or assist in the maintenance of conservation easements held by divisions in the
40 Department of Natural Resources S. and the Department of Agriculture and Food .S .
41 (4) Donations of money deposited into the account and interest on that money shall be
42 expended:
43 (a) as directed by the donor; and
44 (b) without being appropriated by the Legislature.
