             7      LONG TITLE
             8      General Description:
             9          This bill provides that the state pay members of the National Guard on the same level as
             10      their federal counterparts.
             11      Highlighted Provisions:
             12          This bill:
             13          .    requires that the state provide for members of the National Guard who are called
             14      into service on behalf of the state:
             15              .    pay at the same rate as federal servicemembers of the same rank and years of
             16      service; and
             17              .    medical, dental, disability, and death benefits at the same rate as full-time state
             18      employees.

             27      Be it enacted by the Legislature of the state of Utah:
             28          Section 1. Section 39-1-51 is amended to read:
             29           39-1-51. Pay of National Guard members.


             30          (1) When called into the service of the state and not in the service of the United States,
             31      the members of the National Guard shall [receive]:
             32          (a) receive the same pay and allowance as members of the regular army or regular air
             33      force of like rank and length of service[. In addition to the above pay, officers and enlisted
             34      personnel shall receive];
             35          (b) elect to:
             36          (i) receive medical, dental, disability, or death benefits equal to those received by
             37      full-time, permanent state employees; or
             38          (ii) maintain any medical, dental, disability, or death benefits already in place; and
             39          (c) receive one ration per day[; provided, that this].
             40          (2) The state [shall] may not make [no] payments to members of the National Guard [in
             41      the case of] for service for which the United States government makes payment.
