             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Criminal Code regarding prostitution and human trafficking.
             10      Highlighted Provisions:
             11          This bill:
             12          .     provides that if a person exploits prostitution and in the course of that offense
             13      commits the offense of human trafficking for forced sexual exploitation, the person
             14      shall be charged with the human trafficking offense.

             23      Be it enacted by the Legislature of the state of Utah:
             24          Section 1. Section 76-10-1305 is amended to read:
             25           76-10-1305. Exploiting prostitution.
             26          (1) A person is guilty of exploiting prostitution if [he] the person:
             27          (a) procures an inmate for a house of prostitution or place in a house of prostitution for


             28      one who would be an inmate;
             29          (b) encourages, induces, or otherwise purposely causes another to become or remain a
             30      prostitute;
             31          (c) transports a person into or within this state with a purpose to promote that person's
             32      engaging in prostitution or procuring or paying for transportation with that purpose;
             33          (d) not being a child or legal dependent of a prostitute, shares the proceeds of
             34      prostitution with a prostitute pursuant to their understanding that [he] the person is to share
             35      [therein] the proceeds; or
             36          (e) owns, controls, manages, supervises, or otherwise keeps, alone or in association
             37      with another, a house of prostitution or a prostitution business.
             38          (2) Exploiting prostitution is a felony of the third degree.
             39          (3) If the commission of any offense described in Subsection (1) also involves the
             40      commission of human trafficking for forced sexual exploitation under Section 76-5-308 , the
             41      offense shall be charged under Section 76-5-308 .
