             8      General Description:
             9          This bill modifies the Fire Prevention and Safety Act regarding the issuing of blasting
             10      permits.
             11      Highlighted Provisions:
             12          This bill:
             13          .    directs the State Fire Marshal Division to issue blasting permits:
             14              .    when local fire departments are unable to do so; and
             15              .    when the blasting project involves more than one fire department jurisdiction;
             16      and
             17          .    authorizes the State Fire Marshal Division to make administrative rules to
             18      implement these provisions.

             27      Be it enacted by the Legislature of the state of Utah:
             28          Section 1. Section 15A-5-208 is enacted to read:
             29          15A-5-208. Blasting permits.


             30          (1) An operational permit is required for the use of any quantity of explosives or
             31      explosive materials for the purpose of blasting.
             32          (2) The State Fire Marshal Division shall issue blasting permits:
             33          (a) for those locations where the local fire department that has jurisdiction of the
             34      location of the blast does not have a procedure in place for issuing blasting permits; and
             35          (b) for multiple blasting activities that are part of one project and that involve
             36      conducting blasts in the jurisdictions of more than one fire department.
             37          (3) The State Fire Marshal Division shall adopt rules pursuant to Title 63G, Chapter 3,
             38      Utah Administrative Rulemaking Act, as necessary to implement the procedure of issuing
             39      blasting permits under this section.
