             8      General Description:
             9          This bill amends the Mammogram Quality Assurance Chapter of the Utah Health Code.
             10      Highlighted Provisions:
             11          This bill:
             12          .    encourages a facility that performs screening or diagnostic mammography to
             13      provide a patient who has dense breast tissue with notice of options for additional
             14      screening.
             15      Money Appropriated in this Bill:

             21          26-21a-203, as last amended by Laws of Utah 2008, Chapter 382

             23      Be it enacted by the Legislature of the state of Utah:
             24          Section 1. Section 26-21a-203 is amended to read:
             25           26-21a-203. Department rulemaking authority.
             26          The department shall make rules under Title 63G, Chapter 3, Utah Administrative
             27      Rulemaking Act:
             28          (1) establishing quality assurance standards for all facilities performing screening or
             29      diagnostic mammography and developing mammogram x-ray films, including procedures for


             30      clinical follow-up of abnormal mammograms; [and]
             31          (2) providing for:
             32          (a) collection and periodic reporting of mammography examinations and clinical
             33      follow-up data to the department;
             34          (b) certification and revocation of certification of mammogram facilities;
             35          (c) inspection of mammogram facilities, including entry of agents of the department
             36      into the facilities for inspections;
             37          (d) setting fees for certification; and
             38          (e) an appeal process regarding department certification decisions[.]; and
             39          (3) the following information may be included in mammography results sent to a
             40      patient with dense breast tissue:
             41          "Mammography is the only breast cancer screening examination which has been shown
             42      in multiple randomized clinical trials to reduce death rate from breast cancer. However, it is
             43      not a perfect test, specifically in women with dense breast tissue. Because your mammogram
             44      demonstrates that you have dense breast tissue, you may benefit from supplementary screening
             45      tests, depending on your personal risk factors and family history. Although other screening
             46      tests may find additional cancers, they may not necessarily increase survival. Nevertheless, you
             47      should discuss your mammography results with your health care provider. A copy of your
             48      mammography report has been sent to your health care provider's office. Please contact your
             49      health care provider if you have any questions or concerns about this notice."
