             8      General Description:
             9          This bill modifies an early intervention program.
             10      Highlighted Provisions:
             11          This bill:
             12          .    expands an early intervention computer software program to allow the State Board
             13      of Education to include the prekindergarten grade level in the request for proposals
             14      process; and
             15          .    makes technical changes.
             16      Money Appropriated in this Bill:
             17          This bill appropriates:
             18          .    to the State Board of Education - State Office of Education - Initiative Programs, as
             19      a one-time appropriation:
             20              .    from the Education Fund, $100,000.
             21      Other Special Clauses:
             22          This bill provides an effective date.
             23      Utah Code Sections Affected:
             24      AMENDS:
             25          53A-17a-167, as enacted by Laws of Utah 2012, Chapter 420

             27      Be it enacted by the Legislature of the state of Utah:


             28          Section 1. Section 53A-17a-167 is amended to read:
             29           53A-17a-167. Early Intervention Program.
             30          (1) The State Board of Education shall distribute funds appropriated under this section,
             31      consistent with guidelines in this section, to school districts and charter schools that apply for
             32      the funds.
             33          (2) A school district or charter school shall use funds appropriated in this section to
             34      offer an early intervention program, delivered through an enhanced kindergarten program that:
             35          (a) is an academic program focused on building age-appropriate literacy and numeracy
             36      skills;
             37          (b) uses an evidence-based early intervention model;
             38          (c) is targeted to at-risk students; and
             39          (d) is delivered through additional hours or other means.
             40          (3) A school district or charter school may not require a student to participate in an
             41      enhanced kindergarten program described in Subsection (2).
             42          (4) The State Board of Education shall distribute funds appropriated under this section
             43      to school districts and charter schools based on the number of kindergarten students eligible to
             44      receive free or reduced price school lunch in each school district or charter school that applies
             45      for funding under Subsection (1).
             46          (5) In addition to an enhanced kindergarten program described in Subsection (2), the
             47      early intervention program includes a component to address early intervention through the use
             48      of an interactive computer software program.
             49          (6) The State Board of Education shall select one or more technology providers,
             50      through a request for proposals process, to provide an interactive computer software program
             51      for literacy or numeracy instruction, or both, and assessments for students [in] at one or more
             52      of the following grade levels:
             53          (a) prekindergarten;
             54          (b) kindergarten [and]; or
             55          (c) grade 1.
             56          (7) On or before November 1, 2013, and every year thereafter, the State Board of
             57      Education shall report final testing data regarding an interactive computer software program
             58      described in Subsection (6), including student learning gains as a result of the interactive


             59      computer software program, to:
             60          (a) the Education Interim Committee; and
             61          (b) the governor.
             62          Section 2. Appropriation.
             63          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
             64      following sums of money are appropriated from resources not otherwise appropriated, or
             65      reduced from amounts previously appropriated, out of the funds or accounts indicated for the
             66      fiscal year beginning July 1, 2012 and ending June 30, 2013. These are additions to any
             67      amounts previously appropriated for fiscal year 2013.
             68          To State Board of Education - Utah State Office of Education - Initiative Programs
             69              From Education Fund, one-time                     $100,000
             70              Schedule of Programs:
             71                  Contracts and Grants            $100,000
             72          The Legislature intends that:
             73          (1) the $100,000 appropriation for Contracts and Grants shall be used by the State
             74      Board of Education to carry out the requirements of Subsection 53A-17a-167 (6); and
             75          (2) the appropriation under this section:
             76          (a) be one-time; and
             77          (b) not lapse at the close of fiscal year 2013.
             78          Section 3. Effective date.
             79          If approved by two-thirds of all the members elected to each house, this bill takes effect
             80      upon approval by the governor, or the day following the constitutional time limit of Utah
             81      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
             82      the date of veto override, except that Section 2, Appropriation, takes effect on July 1, 2012.
