Chair Ray called the meeting to order at 8:15 a.m.

H.B. 135    Medical Malpractice Amendments (Rep. D. Sanpei)

Rep. Sanpei presented the bill to the committee.

MOTION:    Rep. Kennedy moved to replace H.B. 135 with 1st Substitute H.B. 135, "Medical Malpractice Amendments". The motion passed unanimously , with Rep. Christensen, Rep. Cosgrove and Rep. Menlove absent for the vote.

Spoke in
favor of the bill:    Mr Mark Brinton, Utah Medical Association
            Mr. Charlie Thronson, Utah Association for Justice
            Ms. Michelle McOmber, Utah Medical Association

MOTION:    Rep. Greene moved to pass the bill out favorably, as substituted. The motion passed unanimously.

H.B. 106    Medicaid Inspector General Amendments (Rep. R. Wilcox)

Rep. Wilcox presented the bill to the committee and distributed a handout.

MOTION:    Rep. Chavez-Houck proposed the following amendment:

1.    Page 2, Lines 46 through 50 :    

             46          
{   [   } (4) The inspector general:]

             47          [(a) shall serve a term of two years; and]
             48          [(b) may be removed by the
{   governor   }        state auditor       , for cause.      {   ]   }

             49          [(5) If the inspector general is removed for cause, a new inspector general shall be
             50      appointed, with the advice and consent of the Senate, to serve a two-year term.]

Following committee discussion, Rep. Chavez-Houck withdrew the motion.

MOTION:    Rep. Greene moved to pass H.B. 106 out favorably. The motion passed unanimously.

H.B. 315    Office of Inspector General of Medicaid Services Amendments (J. Dunnigan)

H.B. 141    Medicaid Emergency Room and Primary Care Amendments (M. Kennedy)

H.B. 109    Anesthesiologist Assistant Amendments (B. Dee)

MOTION:    Rep. Redd moved to adjourn the meeting. The motion passed unanimously.

Rep. Ray adjourned the meeting at 9:50 a.m.
