Rep. Oda called the meeting to order at 4:15 p.m.

MOTION:    Rep. Ray moved to approve the minutes of the February 12, 2013 meeting. The motion passed unanimously, with Rep. Layton absent for the vote.

Rep. Oda relinquished the chair to Rep. Greenwood.

H.B. 229    Criminal Identity Fraud Amendments (Rep. C. Oda)

Rep. Oda introduced and explained the bill to the committee with the assistance of Mr. Scott Reed, Division Chief, Criminal Justice, Attorney General's Office. (handout)

MOTION:    Rep. Stratton moved to pass H.B. 229 with a favorable recommendation. The motion passed unanimously.

MOTION:    Rep. Ray moved to place H.B. 229 on the Consent Calendar. The motion passed unanimously.

Rep. Oda resumed the chair.


H.B. 103    Wireless Telephone Use Restrictions (Rep. L. Perry)

H.B. 235    Process Server Amendments (Rep. L. Perry)

Rep. Perry introduced and explained the bill to the committee.

MOTION:    Rep. Greenwood moved to adopt 1st Substitute H.B. 235. The motion passed unanimously, with Rep. Brown absent for the vote.

MOTION:    Rep. Ray moved to amend the bill as follows:

1.    Page 1, Lines 11 through 14 :    

             11          This bill:
             12          .    clarifies who may serve judicial process in the state;
             13          .    prohibits a
  convicted felony       sex offender or a person with a current protective order from serving

             14      process issued by a court;

2.    Page 3, Lines 70 through 71 :    

             70          (4) The following persons may not serve process issued by the courts:
             71          (a) a
  convicted felony       sex offender, as defined in Section 77-41-102 ; or


The motion to amend passed unanimously, with Rep. Brown absent for the vote.

MOTION:     Rep. Layton moved to pass 1st Substitute H.B. 235 with a favorable recommendation. The motion passed unanimously, with Rep. Brown absent for the vote.

This bill was not considered.

MOTION:    Rep. Stratton moved to adjourn the meeting. The motion passed unanimously, with Rep. Brown absent for the vote.
