Chair Osmond called the meeting to order at 4:01 p.m.

S.C.R. 2    Concurrent Resolution Recognizing Workers' Compensation Fund for Workplace (K. Mayne)

Sen. Mayne introduced and explained the bill.

Spoke for the bill:    Mr. Dennis V. Lloyd, Senior Vice President, Workers' Compensation                     Fund

MOTION: Sen. Jones moved to send S.C.R. 2 out of committee with a favorable recommendation. The motion passed unanimously with Sen. Okerland absent for the vote.

S.B. 45    Workers' Compensation and Directors of Officers (E. Vickers)

Sen. Vickers introduced and explained the bill.

MOTION:    Sen. Mayne moved to amend the bill as follows:

1.     Page 3, Line 83:

     Delete "individuals" and insert "officers or directors".

The motion passed unanimously with Sen. Okerland absent for the vote.

Spoke to the bill:    Mr. Craig Moody, Lobbyist, Utah Association for Justice

Spoke to the amendment:    Mr. Dennis V. Lloyd, Senior Vice President, Workers' Compensation                     Fund

MOTION:    Sen. Mayne moved to amend by replacing the previous amendment as follows:

1.    Page 3, Lines 82 through 89 :    

             82          (b) If a corporation makes an election under Subsection (4)(a), the corporation shall
             83      serve written notice naming the individuals
  who are directors or officers       to be excluded from coverage:

             84          (i) upon its insurance carrier [naming the persons to be excluded from coverage.], if
             85      any; or
             86          (ii) upon the commission if the corporation is self insured or has no employee other
             87      than the one or more directors or officers being excluded.
             88          (c) A corporation may exclude no more than five individuals
  who are directors or officers       under Subsection

             89      (4)(b)(ii).

The motion passed unanimously with Sen. Okerlund absent for the vote.

MOTION:     Sen. Jones moved to send S.B. 45 as amended out of committee with a favorable recommendation. The motion passed unanimously with Sen. Okerlund absent for the vote.

M OTION:     Sen. Reid moved to adjourn. The motion passed unanimously.     Chair
Osmond adjourned the meeting at 4:43 p.m.
