             9      General Description:
             10          This bill, subject to certain exceptions, makes it unlawful for a person to remove or
             11      vandalize a campaign sign.
             12      Highlighted Provisions:
             13          This bill:

             15      remove, alter, deface, H. [ cover, ] .H or otherwise vandalize a campaign sign.

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 20A-17-101 is enacted to read:

CHAPTER 17. POLITICAL CAMPAIGN SIGNS


             28          20A-17-101. Title.
             29          This chapter is known as "Political Campaign Signs."
             30          Section 2. Section 20A-17-102 is enacted to read:
             31          20A-17-102. Campaign signs.
             32          (1) Except as provided in Subsection (2), a person is guilty of a class H. [ C ] B .H
             32a      misdemeanor if
             33      the person knowingly removes, alters, defaces, H. [ covers, ] .H or otherwise vandalizes a sign:
             34          (a) advocating the election or defeat of a candidate for public office; or
             35          (b) advocating the approval or defeat of a ballot proposition.
             36          (2) A person is not guilty of a violation of Subsection (1) if the person who engages in
             37      the conduct described in Subsection (1) is:
             38          (a) as it relates to a sign described in Subsection (1)(a), the candidate or an agent of the
             39      candidate;
             40          (b) as it relates to a sign described in Subsection (1)(b), the person who placed the sign,
             41      the person who directed the placement of the sign, or an agent of either;
             42          (c) a property owner of property on which the sign is placed or the property owner's
             43      agent; or
             44          (d) a public official who removes the sign in accordance with an official duty of the
             45      public official.
