Chair Dunnigan called the meeting to order at 2:04 p.m and invited committee members and staff to introduce themselves. Bryant Howe, Assistant Director, explained house standing committee procedures.

H.B. 40    Beer Excise Tax Revenue Amendments (Rep. J. Draxler)

MOTION:    
Rep. Bird moved to amend HB 40 as follows:

1.    Page 4, Lines 114 through 118 :    

             114          (ii) (A) Except for the portion distributed under Subsection 32B-2-404 (1)(b)(iv) and
             115      except as provided in Subsection (2)(a)(ii)(B), a municipality or county shall expend
{   not less

             116      than  
}
  on prevention from local or state revenue of the municipality or county an amount that equals or exceeds       10% of the portion distributed under this part to the municipality or county      {   on prevention   } .

             117          (B) Subsection (2)(a)(ii)(A) does not apply to a municipality that in the prior fiscal year
             118      received a distribution of $5,000 or less under this part.
The motion passed unanimously with Rep. Anderegg and Rep. Duckworth absent for the vote.




Rep. Draxler distributed a handout and explained the bill to the committee assisted by Richard Nance, Director of Utah County Division of Substance Abuse. Doreen Weyland, Commission on Criminal and Juvenile Justice, responded to questions.

MOTION:    Rep. McKell moved to pass H.B. 40 out favorably. The motion passed with Rep. Anderson, Rep. Bird, Rep. Froerer, and Rep. Roberts voting in opposition.

Vice Chair Pitcher assumed the chair.

H.B. 245    State Fire Code Amendments (Rep. J. Dunnigan)

MOTION:    Rep. Dunnigan moved to replace H.B. 245 with 1st Substitute H.B. 245. The motion passed unanimously with Rep. Wiley and Rep. Wilson absent for the vote.

Rep. Dunnigan explained the bill to the committee assisted by Coy Porter, Utah State Fire Marshall.

MOTION:    Rep. Wiley moved to pass 1st Substitute H.B. 245 out favorably. The motion passed unanimously with Rep. Wilson absent for the vote.

MOTION:    Rep. Bird moved to place 1st Sub. H.B. 245 on the Consent Calendar. The motion passed unanimously with Rep. Wilson absent for the vote.

H.B. 26    Association Lien Amendments (Rep. J. Stanard)

MOTION:    Rep. Stanard moved to replace H.B. 26 with 1st Substitute H.B. 26. The motion passed unanimously with Rep. Wilson absent for the vote.

Rep. Stanard explained the bill to the committee.

MOTION:    Rep. Anderegg moved to pass 1st Substitute H.B. 26 out favorably. The motion passed unanimously with Rep. Wilson absent for the vote.


MOTION:    Rep. Anderegg moved to place 1st. Sub. H.B. 26 on the Consent Calendar. The motion passed unanimously with Rep. Wilson absent for the vote.

MOTION:    Rep. Bird moved to adjourn. The motion passed unanimously with Rep. Wilson absent for the vote.
