Vice Chair Ivory called the meeting to order at 4:06 p.m and conducted the meeting.

MOTION:    Rep. Draxler moved to approve the minutes of the February 4, 2014 meeting. The motion passed unanimously with Rep. Noel and Rep. Powell absent for the vote.

H.B. 244    Voting and Voter Registration Amendments (Rep. J. Anderegg)

This bill was not considered.

H.B. 262    Local Governing Body Voting Amendments (Rep. K. Powell)

This bill was not considered.

H.B. 283    Nonprofit Entity Receipt of Government Money (Rep. R. Menlove)

The bill was explained by Rep. Menlove.

MOTION:    Rep. Perry moved to replace HB283 with 1st Substitute HB283. The motion passed unanimously with Rep. Powell absent for the vote.

MOTION:    Rep. Grover moved to amend the bill as follows:

1.    Page 1, Lines 16 through 18 :    

             16              .    imposing requirements on a nonprofit entity's receipt of state money;
  and

             18              .    authorizing a state entity to seek return of state money if the nonprofit entity

MOTION:    Rep. Perry moved to pass the bill out favorably as amended.

SUBSTITUTE MOTION:    Rep. Ivory moved to amend the bill as follows:

1.    Page 5, Line 147 through Page 6, Line 164 :    

             147      Subsection (3)(b)

             148          (4) before the state money is released to the nonprofit entity, the nonprofit entity


             149      submits to the state entity:
             150          (a) a form signed by the board members that certifies that the board members:
             151          (i) have read and understand the nonprofit entity's bylaws; and
             152          (ii) have had explained to them the benefit of insurance covering the activities of the
             153      board; and
             154          (b) (i) a form signed by the chief executive officer, executive director, or board
             155      president that certifies that the board understands basic board responsibilities, including:
             156          (A) determining the mission of the nonprofit entity;
             157          (B) hiring and, if needed, dismissing the chief executive officer or executive director;
             158          (C) planning and evaluating;
             159          (D) recruiting and orienting new board members;
             160          (E) assessing board performance;
             161          (F) providing financial oversight;
             162          (G) ensuring integrity and accountability; or
             163          (H) ensuring adequate resources; or
             164          (ii) a standard of ethics document adopted by the nonprofit entity

The substitute motion passed unanimously with Rep. Grover absent for the vote.

The committee then voted on the original motion to pass the bill out favorably. The motion passed with Rep. Noel voting in opposition. Rep. Grover was absent for the vote.

H.B. 274    Committee Subpoena Powers Amendment (Rep. J. Bird)

The bill was explained by Rep. Bird.

MOTION:    Rep. Mathis moved to pass the bill out favorably. The motion passed unanimously with Rep. Grover and Rep. Perry absent for the vote.

H.B. 282    Amendments to Election Laws (Rep. K. Powell)

MOTION:    Rep. Powell moved to replace HB282 with 1st Substitute HB282. The motion passed unanimously with Rep. Grover and Rep. Perry absent for the vote.

The substitute bill was explained by Rep. Powell with the assistance of Luke Searle, student, Wasatch High School.

Mark Thomas of the Lieutenant Governor's Office answered questions from the committee.

MOTION:        Rep. Noel moved to pass 1st Substitute HB282 out favorably. The motion passed unanimously with Rep. Grover and Rep. Perry absent for the vote.

This bill was not considered.

This bill was not considered.

MOTION:    Rep. Noel moved to adjourn the meeting. The motion passed unanimously with Rep. Grover and Rep. Perry absent for the vote.

Chair Draxler adjourned the meeting at 5:35 p.m.
