Chair McIff called the meeting to order at 2:10 p.m.

H.B. 42    Construction Liens Amendments (Rep. R. C. Webb)

MOTION:    Chair McIff moved to return H.B. 42 to the Rules Committee for the purpose of committee reassignment. The motion passed unanimously with Rep. Christensen and Rep. King absent for the vote.

H.B. 247    Court Parking Facilities (Rep. L. Wiley)

Rep. Wiley explained the bill to the committee.

MOTION:    Rep. Snow moved to amend the bill as follows:


1.    Page 2, Lines 41 through 43 :    

             41          (6) A witness subpoenaed
  to testify in court proceedings       in a civil action shall receive reimbursement for necessary

             42      parking expenses from the attorney issuing the subpoena under rule of the Judicial Council or
             43      Supreme Court.
The motion passed unanimously with Rep. Christensen and Rep. King absent for the vote.




MOTION:    Rep. Snow moved to further amend the bill as follows:


1.    Page 2, Lines 41 through 43 :    

             41          (6) A witness subpoenaed

MOTION:    Rep. Arent moved to pass the bill out favorably as amended. The motion passed unanimously.

H.B. 256    Adoption Records Access Amendments (Rep. J. Nielson)

Rep. Nielson explained the bill, and provided a handout, "HB 256 Adoption Record Amendments," to the committee.

MOTION:    Rep. Perry moved to replace H.B. 256 with 1st Substitute H.B. 256. The motion passed unanimously.

MOTION:    Rep. Greene moved to amend the bill as follows:


1.    Page 6, Lines 164 through 173 :    

             164          [(4)] (6) Upon payment of a fee established in accordance with Section 63J-1-504 , the
             165      office shall make the following records [shall be] available to the public:
             166          (a) except as provided in Subsection 26-2-10 (4)(b), a birth record, excluding
             167      confidential information collected for medical and health use, if 100 years or more have passed
             168      since the date of birth;
             169          (b) a death record if 50 years or more have passed since the date of death;

{   (c) adoption documents as provided in Sections 78B-6-141 and 78B-6-144 ; and   }

  (7) Upon payment of a fee established in accordance with Section 63J-1-504, the office shall make adoption documents available as provided in Sections 78B-6-141 and 78B-6-144.
