7     LONG TITLE
8     General Description:
9          This bill authorizes a person under the age of 16 to fish without a license under certain
10     circumstances.
11     Highlighted Provisions:
12          This bill:
13          ▸     authorizes a person under the age of 16 to fish without a license during a youth
14     organization or school activity; and
15          ▸     makes technical changes.

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 23-19-14.5 is amended to read:
26          23-19-14.5. Persons participating in youth organization or school activity
27     authorized to fish without license.

28          (1) As used in this section:
29          (a) "School" means an elementary school or a secondary school that:
30          (i) is a public or private school located in the state; and
31          (ii) provides student instruction for one or more years of kindergarten through grade 9.
32          (b) "Youth organization" means a local Utah chapter of:
33          (i) the Boy Scouts of America;
34          (ii) the Girls Scouts of the USA; or
35          (iii) an organization that:
36          (A) is exempt from taxation under Section 501(c)(3), Internal Revenue Code; and
37          (B) promotes character building through outdoor activities.
38          (2) The Division of Wildlife Resources shall permit a person to fish without a license
39     during a youth organization or school activity if:
40          (a) the person is:
41          (i) (A) a member of the youth organization; or
42          (B) a student enrolled in the school; and
43          (ii) younger than [14] 16 years old;
44          (b) the fishing is in compliance with all fishing statutes and rules;
45          (c) the activity is part of a recreational or instructional program of the youth
46     organization or school; and
47          (d) an adult leader of the activity obtains from the youth organization or school:
48          (i) a valid tour permit; or
49          (ii) documentation that specifies:
50          (A) the date and place of the fishing activity;
51          (B) the name of the adult leader that will supervise the fishing; and
52          (C) that the activity is officially sanctioned or authorized by the youth organization or
53     school.
54          (3) (a) The adult leader shall Ĥ→ :
54a               (i) possess a valid Utah fishing or combination license; and
54b               (ii) ←Ĥ instruct the activity participants on fishing statutes and
55     rules.
56          (b) The division shall provide educational materials on its website to assist the adult
57     leader in complying with Subsection (3)(a).
58          (4) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the

59     Wildlife Board shall adopt rules specifying the form of the documentation required under
60     Subsection (2)(d)(ii).
