9 General Description:
10 This bill expands the allowable tuition assistance for a Utah National Guard member to
11 include fees.
12 Highlighted Provisions:
13 This bill:
14 ▸ modifies the tuition assistance the Utah National Guard may provide to an active
15 member to attend an institution of higher education to include fees;
16 ▸ defines terms; and
17 ▸ makes technical amendments.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 39-1-63 is amended to read:
28 39-1-63. Tuition and fees assistance for Utah National Guard members -- Use and
29 allocation -- Appropriation.
30 (1) (a) As used in this section, "fees" means general course fees, in addition to tuition,
31 that are:
32 (i) imposed by an institution of higher education; and
33 (ii) required to be paid by a student to engage in a course of study at the institution of
34 higher education.
35 (b) "Fees" does not include a special course fee.

38 member of the Utah National Guard for study at an institution of higher education, subject to
39 the following requirements:
40 (a) the individual must be, at the time [
41 an active member of the Utah National Guard[
42 (b) the assistance is for tuition and fees only and [
43 the resident tuition and fees for the actual course of postsecondary study engaged in by the
44 individual.

47 (b) An individual may apply to the adjutant general of the state for assistance for each
48 year during which [
49 (c) In awarding assistance, the adjutant general shall consider the recruitment and
50 retention needs of the Utah National Guard.

52 (4) The adjutant general of the state shall pay the tuition and fees assistance directly to
53 [

55 and reports necessary to administer the allocation of assistance and payment of funds under this
56 section.

60 National Guard is not eligible for the tuition and fees assistance in this section for one year
61 from the date of transfer.
