7     LONG TITLE
8     General Description:
9          This bill modifies the Nurse Practice Act.
10     Highlighted Provisions:
11          This bill:
12          ▸     amends the requirements for a nursing education program to qualify as an approved
13     education program;
14          ▸     amends the division's rulemaking authority related to limited-time approved
15     education programs; and
16          ▸     makes technical changes.

25     Be it enacted by the Legislature of the state of Utah:
26          Section 1. Section 58-31b-601 is amended to read:
27          58-31b-601. Minimum standards for nursing programs -- Medication aide
28     training.
29          (1) Except as provided in Subsection (2), to qualify as an approved education program

30     for the purpose of qualifying graduates for licensure under this chapter, a nursing education
31     program shall be accredited by [the:] an accrediting body for nursing education that is approved
32     by the United States Department of Education.
33          [(a) Commission on Collegiate Nursing Education;]
34          [(b) National League for Nursing Accrediting Commission; or]
35          [(c) Council on Accreditation of Nurse Anesthesia Educational Programs.]
36          (2) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
37     division, in consultation with the board, may make rules establishing requirements for a
38     nursing education program to qualify for a limited time as an approved education program for
39     the purpose of qualifying graduates for licensure under this chapter, [prior to its obtaining an] if
40     the program:
41          (a) is in the process of obtaining the accreditation described in Subsection (1)[.];
42          (b) has recently been denied accreditation after seeking to obtain the accreditation
43     described in Subsection (1); or
44          (c) has recently lost the accreditation described in Subsection (1).
45          (3) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, and
46     the provisions of this chapter, the division shall make rules defining the minimum standards for
47     a medication aide certified training program to qualify a person for certification under this
48     chapter as a medication aide certified.
