9 This bill amends provisions related to the pilot online school survey program.
10 Highlighted Provisions:
11 This bill:
12 ▸ extends the pilot online school survey program for an additional year;
13 ▸ amends the repeal date related to the pilot online school survey; and
14 ▸ makes technical changes.

27 Be it enacted by the Legislature of the state of Utah:
28 Section 1. Section 53A-1-411 is amended to read:
29 53A-1-411. Pilot online school survey program.
30 (1) As used in this section, "board" means the State Board of Education.
31 (2) (a) Beginning with the 2012-13 school year, the State Board of Education shall
32 establish a [
33 representatives of local school boards, charter school governing boards, school district and
34 school administrators, teachers, and parents.
35 (b) The board shall develop the technology, or contract with a provider selected
36 through a request for proposals process to provide the technology, for the pilot online school
37 survey [
38 (3) The purposes of the pilot online school survey [
39 (a) provide information to school districts and schools on how to better serve and meet
40 the needs of students and parents;
41 (b) allow school districts and schools to monitor progress of school improvement
42 efforts; and
43 (c) provide data that may be used as part of a school district's or school's educator
44 evaluation system and inform decisions about employment and professional development.
45 (4) The pilot online school survey [
46 (a) age appropriate surveys for students to evaluate each of their teachers;
47 (b) age appropriate surveys for students to evaluate their school's administrators;
48 (c) a survey for parents to evaluate their children's teachers;
49 (d) a survey for parents to evaluate their children's schools and administrators,
50 including whether the school or administrators solicited parent involvement in the school;
51 (e) a survey for parents to self-evaluate their participation in their children's education,
52 including attendance at parent teacher conferences, involvement in the school, and involvement
53 in their children's homework;
54 (f) a survey for teachers to evaluate their school, including safety and security of the
55 school;
56 (g) a survey for teachers to evaluate their school's administrators and, if applicable,
57 their school district's administrators;
58 (h) statistically valid and reliable measurement tools; and
59 (i) survey questions that represent information that a student, parent, or teacher has
60 direct knowledge of.
61 (5) (a) Except as provided in Subsection (5)(b), the pilot online school survey program
62 instruments shall be uniform statewide to allow for comparison of:
63 (i) survey results statewide; and
64 (ii) survey results from year to year.
65 (b) The State Board of Education may allow a school participating in the pilot online
66 school survey program to create a supplement to the pilot online school survey program
67 instrument that includes items specific to the school.
68 (6) (a) The board shall select a sampling of schools to participate in and administer the
69 pilot online school survey program to students, parents, and teachers.
70 (b) The sampling of urban and rural schools selected by the board shall:
71 (i) represent at least 5% of total state enrollment in public schools; and
72 (ii) include at least:
73 (A) eight elementary schools;
74 (B) eight junior high or middle schools;
75 (C) eight high schools; and
76 (D) five charter schools.
77 (c) The schools selected in Subsection (6)(b)(ii) shall be selected from at least five
78 school districts.
79 (d) Except as provided in Subsection (6)(e), a participating school shall survey all of
80 the students enrolled in the participating school.
81 (e) A participating school shall survey:
82 (i) students in grades 1 and 2 if considered appropriate;
83 (ii) students in grades 3 through 12; and
84 (iii) parents and teachers of students in kindergarten through grade 12.
85 (7) (a) A participating school shall, annually for an elementary school or semi-annually
86 for a secondary school:
87 (i) administer online student surveys of teachers for each of a student's teachers;
88 (ii) make available to parents online access to surveys, which they may complete for
89 each of their children's teachers and schools; and
90 (iii) make available to teachers online access to a survey of their school, which they
91 may complete.
92 (b) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
93 State Board of Education shall make rules establishing procedures for administering or making
94 available online the surveys specified in Subsection (7)(a), including rules to ensure the privacy
95 and protection of individual educator survey results.
96 (8) The survey data shall be available to:
97 (a) the State Board of Education for the purpose of analyzing and aggregating the
98 survey data; and
99 (b) school district and school administrators for the purposes stated in Subsection [

108 (a) the response rate of students, parents, and teachers in each of the participating
109 schools; and
110 (b) the reliability of the pilot online school survey [

112 Section 2. Section 63I-2-253 is amended to read:
113 63I-2-253. Repeal dates -- Titles 53, 53A, and 53B.
114 (1) Section 53A-1-402.7 is repealed July 1, 2014.
115 (2) Section 53A-1-403.5 is repealed July 1, 2017.
116 (3) Subsection 53A-1-410(5) is repealed July 1, 2015.
117 (4) Section 53A-1-411 is repealed July 1, [
118 (5) Section 53A-1a-513.5 is repealed July 1, 2017.
119 (6) Title 53A, Chapter 1a, Part 10, UPSTART, is repealed July 1, 2019.
120 (7) Title 53A, Chapter 8a, Part 8, Peer Assistance and Review Pilot Program, is
121 repealed July 1, 2017.
122 (8) Section 53A-17a-169 is repealed July 1, 2017.
123 Section 3. Appropriation.
124 Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, for
125 the fiscal year beginning July 1, 2015, and ending June 30, 2016, the following sums of money
126 are appropriated from resources not otherwise appropriated, or reduced from amounts
127 previously appropriated, out of the funds or accounts indicated. These sums of money are in
128 addition to any amounts previously appropriated for fiscal year 2016.

134 The Legislature intends that:
135 (1) the State Board of Education use the appropriation under this section to implement
136 the pilot online school survey program created in Section 53A-1-411; and
137 (2) the appropriation under this section be:
138 (a) ongoing; and
139 (b) non-lapsing.
140 Section 4. Effective date.
141 (1) Except as provided in Subsection (2), this bill takes effect on May 12, 2015.
142 (2) Uncodified Section 3, Appropriation, takes effect on July 1, 2015.
