8 General Description:
9 This joint resolution of the Legislature expresses that, due to the inherent risks of
10 agricultural tourism activities, a person engaged in these activities should not be able to
11 recover damages from an agricultural tourism operator for injuries resulting from those
12 inherent risks.
13 Highlighted Provisions:
14 This resolution:
15 ▸ recognizes that some risks are inherent in agricultural tourism activities; and
16 ▸ expresses that, due to these inherent risks, a person engaged in agricultural tourism
17 activities should not be able to recover from an agricultural tourism operator for
18 injuries resulting from those inherent risks.

22 Be it resolved by the Legislature of the state of Utah:
23 WHEREAS, agricultural tourism activities are practiced by a large number of residents
24 of Utah;
25 WHEREAS, these agricultural tourism activities contribute significantly to the
26 economy of the state;
27 WHEREAS, few insurance carriers are willing to provide liability insurance protection
28 to agricultural tourism operators;
29 WHEREAS, the premiums charged by liability insurance carriers have risen sharply in
30 recent years;
31 WHEREAS, the sharp rise in premiums is due to confusion as to whether a participant
32 in an agricultural tourism activity assumes the risks inherent in the agricultural tourism activity;
33 WHEREAS, some risks are inherent in agricultural tourism activities; and
34 WHEREAS, a person engaged in agricultural tourism activities should not be able to
35 recover damages from an agricultural tourism operator for injuries resulting from those
36 inherent risks:
37 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
38 recognizes that some risks are inherent in agricultural tourism activities.
39 BE IT FURTHER RESOLVED that the Legislature of the state of Utah expresses that,
40 due to these inherent risks, persons engaged in agricultural tourism activities should not be able
41 to recover damages from an agricultural tourism operator for injuries resulting from those
42 inherent risks.
43 BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Utah
44 Insurance Department, the Utah Association of Independent Insurance Agents, and the
45 members of Utah's congressional delegation.
