8 General Description:
9 This bill amends provisions related to dual enrollment of public school students.
10 Highlighted Provisions:
11 This bill:
12 ▸ defines terms;
13 ▸ provides that a dual enrollment student may participate on a part-time basis in
14 academic activities or programs that are designated as full-time; and
15 ▸ makes technical and conforming changes.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 53A-11-102.5 is amended to read:
26 53A-11-102.5. Dual enrollment.
27 (1) As used in this section:
28 (a) "District school" means a public school under the control of a local school board
29 elected pursuant to Title 20A, Chapter 14, Nomination and Election of State and Local School
30 Boards.
31 (b) "Dual enrollment student" means a student who is enrolled in a:
32 (i) private school or a home school; and
33 (ii) public school.

38 participate in any academic activity or program in the public school that is available to students

41 (b) Except as provided in Subsection (3)(c), a dual enrollment student is subject to the
42 same rules and requirements that apply to other students' participation in the activity or
43 program.
44 (c) For activities or programs that are designated as full-time, a dual enrollment student
45 may participate on a part-time basis.
46 (4) (a) A [
47 is enrolled in a district school is considered a student of the district in which the district school
48 of attendance is located for purposes of state funding to the extent of the student's participation
49 in the district school programs.

51 enrolled in a charter school is considered a student of the charter school for purposes of state
52 funding to the extent of the student's participation in the charter school programs.
53 (5) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
54 State Board of Education shall make rules for purposes of dual enrollment to govern and
55 regulate the transferability of credits toward graduation that are earned in a private or home
56 school.
