8     LONG TITLE
9     General Description:
10          This bill modifies the Utah Construction Trades Licensing Act.
11     Highlighted Provisions:
12          This bill:
13          ▸     modifies the continuing education requirements for certain contractor licensees; and
14          ▸     makes technical changes.

23     Be it enacted by the Legislature of the state of Utah:
24          Section 1. Section 58-55-302.5 is amended to read:
25          58-55-302.5. Continuing education requirements for contractor licensees --

26     Continuing education courses.
27          (1) Each contractor licensee under a license issued under this chapter shall complete
28     six hours of approved continuing education during each two-year renewal cycle established by
29     rule under Subsection 58-55-303(1).
30          (2) (a) The commission shall, with the concurrence of the division, establish by rule a
31     program of approved continuing education for contractor licensees.
32          (b) Beginning on or after June 1, 2015, only courses offered by any of the following
33     may be included in the program of approved continuing education for contractor licensees:[(b)
34     Before a new course or a course being considered for reapproval may be included in the
35     program of approved continuing education for contractor licensees, the commission and the
36     division shall invite and consider written input, received within 30 days of the invitation,
37     regarding the course from:]
38          (i) the Associated General Contractors of Utah;
39          (ii) Associated Builders and Contractors, Utah Chapter;
40          [(ii)] (iii) the Home Builders Association of Utah;
41          [(iii) the Utah Subcontractors Council;]
42          (iv) the National Electrical Contractors Association;
43          [(iv)] (v) the Utah Plumbing & Heating Contractors Association;
44          [(v)] (vi) the Independent Electrical Contractors of Utah; [and]
45          [(vi)] (vii) the Rocky Mountain Gas Association[.];
46          (viii) the Utah Mechanical Contractors Association;
47          (ix) the Sheet Metal Contractors Association;
48          (x) the Intermountain Electrical Association;
49          (xi) the Builders Bid Service of Utah;
50          (xii) Utah Roofing Contractors Association;
51          (xiii) a nationally or regionally accredited college or university that has a physical
52     campus in the state; or
53          (xiv) an agency of the state.
54          (c) Each entity listed in Subsections (2)(b)(iv) through (2)(b)(xii) may only offer and
55     market continuing education courses to a licensee who is a member of the entity.
56          (3) The division may contract with a person to establish and maintain a continuing

57     education registry to include:
58          [(a) an online application for a continuing education course provider to apply to the
59     division for approval of the course for inclusion in the program of approved continuing
60     education;]
61          [(b)] (a) a list of courses that the division has approved for inclusion in the program of
62     approved continuing education; and
63          [(c)] (b) a list of courses that:
64          (i) a contractor licensee has completed under the program of approved continuing
65     education; and
66          (ii) the licensee may access to monitor the licensee's compliance with the continuing
67     education requirement established under Subsection (1).
68          (4) The division may charge a fee, as established by the division under Section
69     63J-1-504, to administer the requirements of this section.
