7 LONG TITLE
8 General Description:
9 This bill amends the Medicaid program to permit an expansion of the Medicaid
10 program under certain conditions.
11 Highlighted Provisions:
12 This bill:
13 ▸ authorizes the Utah Department of Health and the governor to extend Medicaid
14 benefits:
15 • to an individual who is below 100% of the federal poverty level;
16 • if the Medicaid benefit package offered to the newly eligible is the current
17 Medicaid benefit package; and
18 • if the department gets the maximum federal match rate for the Medicaid
19 expansion.

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 26-18-18 is amended to read:
30 26-18-18. Optional Medicaid expansion.
31 (1) For purposes of this section "PPACA" [
32 defined in Section 31A-1-301.
33 (2) The department and the governor shall not expand the state's Medicaid program to
34 the optional Medicaid expansion population under PPACA unless:

44 (a) the expansion of the state Medicaid program is in accordance with Subsection (3);
45 or
46 [
47 Subsection 63J-5-103(2), the governor submits the request for expansion of the Medicaid
48 program for optional Medicaid expansion populations to the Legislature under the high impact
49 federal funds request process required by Section 63J-5-204, Legislative review and approval
50 of certain federal funds request.
51 (3) The department may expand the Medicaid program:
52 (a) to an individual who is below 100% of the federal poverty level;
53 (b) if the department offers the current Medicaid benefit structure to an individual
54 under Subsection (3)(a); and
55 (c) if the department obtains the maximum federal financial participation for the
56 expansion population as set forth in 42 U.S.C. Sec. 1396d(y).
