7     LONG TITLE
8     General Description:
9          This bill modifies the Utah Occupational Safety and Health Act relating to the duties of
10     employers and employees.
11     Highlighted Provisions:
12          This bill:
13          ▸     clarifies the duties of employers and employees;
14          ▸     grants rulemaking authority to the Labor Commission; and
15          ▸     makes technical and conforming changes.

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 34A-6-201 is amended to read:
26          34A-6-201. Duties of employers and employees.
27          (1) Each employer shall [furnish each of the employer's employees employment and a
28     place of employment free from recognized hazards that are causing or are likely to cause death
29     or physical harm to the employer's employees and comply with the standards promulgated

30     under this chapter.]:
31          (a) furnish to each of its employees employment and a place of employment that are
32     free from recognized hazards that are causing or are likely to cause death or serious physical
33     harm to its employees; and
34          (b) comply with occupational safety and health standards promulgated under this
35     chapter.
36          (2) Each employee shall comply with [the] occupational safety and health standards[,
37     orders, and rules made under this chapter] and the rules and orders issued pursuant to this
38     chapter that are applicable to the employee's own actions and conduct.
39          (3) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
40     commission may make rules that are necessary to implement this section for a workplace with
41     multiple employers.
