23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 78B-12-401 is amended to read:
25 78B-12-401. Advisory committee -- Membership -- Expiration.
26 (1) On or before May 1, 2012, and then on or before May 1 of every fourth year
27 subsequently, the governor shall appoint a child support guidelines advisory committee
28 consisting of:
29 (a) one representative recommended by the Office of Recovery Services;
30 (b) one representative recommended by the Judicial Council;
31 (c) two representatives recommended by the Utah State Bar Association;
32 (d) two representatives of noncustodial parents;
33 (e) two representatives of custodial parents;
34 (f) one representative with expertise in economics; and
35 (g) two representatives from diverse interests related to child support issues, as the
36 governor may consider appropriate. However, none of the individuals appointed under this
37 subsection may be members of the Utah State Bar Association.
38 (2) The term of the committee members expires one month after the report of the
39 committee is submitted to the Legislature under Section 78B-12-402.
40 (3) When a vacancy occurs in the membership for any reason, the replacement shall be
41 appointed for the unexpired term.
42 (4) The committee ceases to exist no later than November 1, [
43 or before November 1 of every fourth year subsequently.
44 Section 2. Section 78B-12-402 is amended to read:
45 78B-12-402. Duties -- Report -- Staff.
46 (1) The advisory committee shall review the child support guidelines to ensure their
47 application results in the determination of appropriate child support award amounts.
48 (2) The committee shall report to the Legislative Judiciary Interim Committee on or
49 before October 1, [
50 subsequently.
51 (3) The committee's report shall include recommendations of the majority of the
52 committee, as well as specific recommendations of individual members of the committee.
53 (4) Staff for the committee shall be provided from the existing budget of the
54 Department of Human Services.
