25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 53A-3-432 is enacted to read:
27 53A-3-432. Interlocal agreement for public education transportation services.
28 (1) In accordance with Title 11, Chapter 13, Interlocal Cooperation Act, at least two
29 school districts may, for the purpose of coordinating public education transportation services:
30 (a) create an interlocal entity as defined in Section 11-13-103 if the school districts
31 establish an interlocal entity governing body as described in Subsection (2); or
32 (b) enter into a joint or cooperative undertaking as described in Section 11-13-207 if
33 the school districts establish a joint board as described in Subsection (2).
34 (2) A governing body described in Subsection (1)(a) or a joint board described in
35 Subsection (1)(b) shall consist of:
36 (a) at least one elected member of a local school board from each school district that
37 creates the interlocal entity or enters into the joint or cooperative undertaking; and
38 (b) only elected members of the local school boards of the school districts that create
39 the interlocal entity or enter into the joint or cooperative undertaking.
40 Section 2. Coordinating S.B. 240 with H.B. 251 -- Technical amendment.
41 If this S.B. 240 and H.B. 251, Amendments to the Interlocal Act, both pass and become
42 law, it is the intent of the Legislature that the Office of Legislative Research and General
43 Counsel, in preparing the Utah Code database for publication, change the terminology in
44 Subsections 53A-3-432(1)(a) and (2) from "governing body" to "governing board".
