8     LONG TITLE
9     General Description:
10          This bill creates a National Board Certification Scholarship Program for public school
11     teachers.
12     Highlighted Provisions:
13          This bill:
14          ▸     defines terms;
15          ▸     creates the National Board Certification Scholarship Program;
16          ▸     directs the State Board of Education to:
17               •     award grants, on a competitive basis, to eligible teachers to attain a National
18     Board Certification or renew an existing National Board Certification;
19               •     select an independent evaluator, through a request for proposals process, to
20     evaluate the effectiveness of National Board Certified Teachers; and
21               •     make rules; and
22          ▸     repeals the National Board Certification Scholarship Program, except provisions
23     related to scholarship repayment, on July 1, 2018.
24     Money Appropriated in this Bill:
25          This bill appropriates in fiscal year 2016:

26          ▸     to the State Board of Education - State Office of Education - Initiative Programs, as
27     a one-time appropriation:
28               •     from the Education Fund, $370,000.
29     Other Special Clauses:
30          This bill provides a special effective date.

39     Be it enacted by the Legislature of the state of Utah:
40          Section 1. Section 53A-6-1001 is enacted to read:
41     
Part 10. The National Board Certification Scholarship Program

42          53A-6-1001. Title.
43          This part is known as "The National Board Certification Scholarship Program."
44          Section 2. Section 53A-6-1002 is enacted to read:
45          53A-6-1002. Definitions.
46          (1) "Board" means the State Board of Education.
47          (2) "Eligible teacher" means a teacher that:
48          (a) has been licensed under Title 53A, Chapter 6, Educator Licensing and Professional
49     Practices Act;
50          (b) is employed by an LEA; and
51          (c) meets other criteria as determined by the board.
52          (3) "Local education agency" or "LEA" means a school district, charter school, or the
53     Utah Schools for the Deaf and the Blind.
54          (4) "National Board Certification" or "certificate" means a certificate issued by the
55     National Board for Professional Teaching Standards.
56          Section 3. Section 53A-6-1003 is enacted to read:

57          53A-6-1003. National Board Certification Scholarship Program.
58          (1) The National Board Certification Scholarship Program is created to:
59          (a) award scholarships to eligible teachers, on a competitive basis, to:
60          (i) attain a National Board Certification; or
61          (ii) renew a National Board Certification; and
62          (b) evaluate the effectiveness of National Board Certified Teachers.
63          (2) Subject to legislative appropriations, the board shall award scholarships to eligible
64     teachers, on a competitive basis, for:
65          (a) the cost to attain or renew a National Board Certification; and
66          (b) up to four days of paid professional development time that may be used to:
67          (i) cover the cost of a substitute during the school year; or
68          (ii) provide a stipend for professional development attended during the summer.
69          (3) As a condition of receiving a scholarship under this section, an eligible teacher
70     shall agree to repay the scholarship, in accordance with Subsections (4)(a) and (b), if the
71     eligible teacher receives the scholarship and:
72          (a) does not complete the certificate within three years of the date on which the
73     scholarship was awarded; or
74          (b) leaves state employment within five years of the date on which the scholarship was
75     awarded.
76          (4) If scholarship repayment is required under Subsection (3), the board shall:
77          (a) prorate the amount of the scholarship to be repaid under Subsection (3)(b) based on
78     the amount of time that the scholarship recipient was employed by the state after receiving the
79     scholarship;
80          (b) amortize the amount of the scholarship repayment over five years at a fixed rate of
81     5% simple interest; and
82          (c) deposit scholarship repayment proceeds into the restricted account described in
83     Subsection (6).
84          (5) The board shall make rules, in accordance with Title 63G, Chapter 3, Utah
85     Administrative Rulemaking Act, specifying:
86          (a) procedures for applying for scholarships under Subsection (2); and
87          (b) criteria for awarding scholarships under Subsection (2).

88          (6) The board shall create a restricted account consisting of:
89          (a) funds appropriated by the Legislature for the National Board Certification
90     Scholarship Program; and
91          (b) scholarship repayment proceeds described in Subsection (4)(c).
92          (7) (a) The board shall select an independent evaluator, through a request for proposals
93     process, to act as an independent contractor to conduct longitudinal research on the
94     effectiveness of National Board Certified Teachers, including a comparison of the student
95     learning gains of students taught by National Board Certified Teachers to the student learning
96     gains of students taught by other national teacher certification organizations.
97          (b) The board shall ensure that a contract with an independent evaluator selected under
98     Subsection (7)(a) require the independent evaluator to report to the Education Interim
99     Committee on or before November 1, 2017.
100          Section 4. Section 63I-1-253 is amended to read:
101          63I-1-253. Repeal dates, Titles 53, 53A, and 53B.
102          The following provisions are repealed on the following dates:
103          (1) Section 53-3-232, Conditional license, is repealed July 1, 2015.
104          (2) Subsection 53-10-202(18) is repealed July 1, 2018.
105          (3) Section 53-10-202.1 is repealed July 1, 2018.
106          (4) Title 53A, Chapter 1a, Part 6, Public Education Job Enhancement Program is
107     repealed July 1, 2020.
108          (5) Subsections 53A-6-1003(2), (5), and (7), are repealed July 1, 2018.
109          [(5)] (6) Title 53A, Chapter 11, Part 15, School Safety Tip Line, is repealed July 1,
110     2015.
111          [(6)] (7) The State Instructional Materials Commission, created in Section 53A-14-101,
112     is repealed July 1, 2016.
113          [(7)] (8) Subsections 53A-16-113(3) and (4) are repealed December 31, 2016.
114          [(8)] (9) Section 53A-16-114 is repealed December 31, 2016.
115          [(9)] (10) Section 53A-17a-163, Performance-based Compensation Pilot Program is
116     repealed July 1, 2016.
117          [(10)] (11) Section 53B-24-402, Rural residency training program, is repealed July 1,
118     2015.

119          [(11)] (12) Subsection 53C-3-203(4)(b)(vii), which provides for the distribution of
120     money from the Land Exchange Distribution Account to the Geological Survey for test wells,
121     other hydrologic studies, and air quality monitoring in the West Desert, is repealed July 1,
122     2020.
123          Section 5. Appropriation.
124          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, for
125     the fiscal year beginning July 1, 2015, and ending June 30, 2016, the following sums of money
126     are appropriated from resources not otherwise appropriated, or reduced from amounts
127     previously appropriated, out of the funds or accounts indicated. These sums of money are in
128     addition to any amounts previously appropriated for fiscal year 2016.
129          To State Board of Education - State Office of Education - Initiative Programs

131          Schedule of Programs:
132               National Board Certification Scholarship Program          $370,000
133          The Legislature intends that:
134          (1) the State Board of Education:
135          (a) use at least $100,000 of the appropriation provided in this section to award
136     scholarships for teachers to attain a National Board Certification;
137          (b) use at least $70,000 of the appropriation provided in this section to award
138     scholarships for teachers to renew a National Board Certification;
139          (c) use up to $200,000 of the appropriation provided in this section for an independent
140     evaluation of the program; and
141          (d) expend appropriations provided under this section in fiscal years 2016, 2017, and
142     2018; and
143          (2) appropriations provided under this section not lapse.
144          Section 6. Effective date.
145          (1) Except as provided in Subsection (2), this bill takes effect on May 12, 2015.
146          (2) Uncodified Section 5, Appropriation, takes effect on July 1, 2015.
