9 General Description:
10 This bill modifies the Utah Construction Trades Licensing Act.
11 Highlighted Provisions:
12 This bill:
13 ▸ defines "certified HVAC technician";
14 ▸ requires the Construction Services Commission to create a continuing education
15 program for certified HVAC technicans;
16 ▸ requires a licensee who is a "certified HVAC technician" to complete eight hours of
17 continuing education every two years;
18 ▸ grants rulemaking authority to the commission, with the concurrence of the Division
19 of Occupational and Professional Licensing (DOPL), to create the continuing
20 education program; and
21 ▸ provides that DOPL may charge a fee to administer the continuing education
22 program.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 58-55-302.8 is enacted to read:
33 58-55-302.8. Continuing education requirements for a licensee who is authorized
34 to install a gas or combustion system.
35 (1) As used in this section, "certified HVAC technician" means an individual:
36 (a) whose license authorizes the individual to install, repair, maintain, clean, or replace
37 a residential or commercial gas appliance or a combustion system as described in Subsection
38 58-55-308(2); and
39 (b) who has received the training and certification described in Subsection
40 58-55-308(2)(c).
41 (2) The commission shall, with the concurrence of the division, establish by rule a
42 continuing education program for certified HVAC technicians.
43 (3) Beginning January 1, 2016, during each two-year renewal cycle established by rule
44 under Subsection 58-55-303(1), a certified HVAC technician shall complete eight hours of
45 continuing education.
46 (4) The division may contract with a person to establish and maintain a continuing
47 education registry to include:
48 (a) an online application for a continuing education course provider to apply to the
49 division for approval of the course for inclusion in the continuing education program;
50 (b) a list of courses that the division has approved for inclusion in the continuing
51 education program; and
52 (c) a list of courses that a certified HVAC technician:
53 (i) has completed under the continuing education program; and
54 (ii) may access to monitor compliance with the continuing education requirements
55 under Subsection (2).
56 (5) The division may charge a fee, established by the division under Section 63J-1-504,
57 to administer the requirements of this section.
