7     LONG TITLE
8     General Description:
9          This bill modifies provisions relating to achievement tests.
10     Highlighted Provisions:
11          This bill:
12          ▸     provides that the State Board of Education shall develop, publish, and administer
13     each test that is a part of U-PASS.

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 53A-1-604 is amended to read:
24          53A-1-604. Test development, publication, and administration.
25          (1) The State Board of Education shall develop, publish, and administer
26     [criterion-referenced tests] each test that is a part of U-PASS.
27          [(2) The board may use the expert services of any person in the public or private sector
28     in:]
29          [(a) evaluating current tests and assessment programs; or]
30          [(b) developing, publishing, and administering new tests.]
31          (2) The State Board of Education may not contract with any person in the private sector
32     to:
33          (a) evaluate current tests and assessment programs; or
34          (b) develop, publish, or administer a test that is a part of U-PASS.
