7     LONG TITLE
8     General Description:
9          This bill enacts provisions that allow a teacher who is licensed out of state to teach
10     students in Utah remotely.
11     Highlighted Provisions:

25     Be it enacted by the Legislature of the state of Utah:

26          Section 1. Section 53A-6-114 is enacted to read:
27          53A-6-114. Distance learning -- License requirements.
28          (1) As used in this section, "distance learning" means instruction of curriculum that is:
29          (a) aligned with the core curriculum standards established by the board; and
30          (b) delivered from a remote location across state lines.
31          (2) A teacher who provides distance learning to a student in Utah is not required to
32     hold a license if:
33          (a) the teacher holds a teaching credential:
34          (i) issued by another state that is approved as described in Subsection (3); and
35          (ii) for the grade level of and subject taught to the Utah student; and
36          (b) the teacher passes a criminal background check described in Section 53A-6-401.
37          (3) The board shall review teacher credentialing standards in all other states and, by
38     rule, approve a state if the state's teacher credentialing standards do not differ from comparable
39     licensing under this part to an extent that would impede the ability of a teacher described in
40     Subsection (2) to provide instruction aligned with the core curriculum standards established by
41     the board.
42          Section 2. Coordinating S.B. 275 with H.B. 360 -- Technical amendment.
43          If this S.B. 275 and H.B. 360, Utah Education Amendments, both pass and become law,
44     it is the intent of the Legislature that the Office of Legislative Research and General Counsel,
45     in preparing the Utah Code database for publication, change the terminology in Subsections
46     53A-6-114(1)(a) and (3) from "core curriculum standards" to "core standards for Utah public
47     schools".
48          Section 3. Coordinating S.B. 275 with H.B. 124 -- Substantive amendment.
49          If this S.B. 275 and H.B. 124, Education Background Check Amendments, both pass
50     and become law, it is the intent of the Legislature that the Office of Legislative Research and
51     General Counsel, in preparing the Utah Code database for publication, amend Subsection
52     53A-6-114(2)(b) to read:
53          "(b) the teacher passes the same criminal background check and ongoing monitoring
54     required of a license applicant as described in Section 53A-15-1504."
