8 General Description:
9 This bill creates a National Housing Trust Fund Advisory Council.
10 Highlighted Provisions:
11 This bill:
12 ▸ creates the National Housing Trust Fund Advisory Council to allocate federal
13 Housing Trust Fund money made available to the state to benefit certain low
14 income households;
15 ▸ provides for the membership of the council;
16 ▸ requires the council to prepare an annual allocation plan for federal Housing Trust
17 Fund money; and
18 ▸ provides for certain reporting.

27 Be it enacted by the Legislature of the state of Utah:
28 Section 1. Section 35A-8-509 is enacted to read:
29 35A-8-509. National Housing Trust Fund Advisory Council -- Membership --
30 Staffing -- Duties -- Reports.
31 (1) There is created the National Housing Trust Fund Advisory Council consisting of
32 the following 16 members:
33 (a) the chair of the Olene Walker Housing Loan Fund or the chair's designee;
34 (b) the president of the Utah Housing Corporation or the president's designee;
35 (c) two persons from the financial industry with expertise in loans or investments in
36 Federal Low Income Housing Tax Credits, designated by the president of the Utah Housing
37 Corporation;
38 (d) one person, designated by the Utah Community Reinvestment Corporation;
39 (e) one person representing municipalities, designated by the Utah League of Cities and
40 Towns;
41 (f) one person representing counties, designated by the Utah Association of Counties;
42 (g) the president of the Utah Association of Realtors or the president's designee;
43 (h) three persons representing expertise in maintaining or developing affordable
44 housing, designated by the executive director of the Department of Workforce Services;
45 (i) the executive director of the Utah Housing Coalition or the executive director's
46 designee;
47 (j) the executive director of the Department of Human Services or the executive
48 director's designee;
49 (k) the executive director of the Department of Workforce Services, or the executive
50 director's designee;
51 (l) one person who is a member of the National Association of Housing and
52 Redevelopment Officials, designated by the executive director of the Department of Workforce
53 Services; and
54 (m) a member of the public who lives or has lived in low-income subsidized housing,
55 designated by the executive director of the Department of Workforce Services.
56 (2) The members of the council shall annually elect a chair from among the
57 membership of the council.
58 (3) (a) A member of the council shall serve until replaced as determined by the
59 designating authority.
60 (b) When a vacancy occurs in the membership of the council for any reason, the
61 replacement shall be appointed for the unexpired term in the same manner as the initial
62 appointment.
63 (4) (a) The chair, or a majority of the council, may call a meeting of the council.
64 (b) A majority of members of the council constitute a quorum for the transaction of
65 business.
66 (c) The council shall:
67 (i) meet at least quarterly; and
68 (ii) comply with the procedures and requirements of Title 52, Chapter 4, Open and
69 Public Meetings Act.
70 (5) A member may not receive compensation or benefits for the member's service, but
71 may receive per diem and travel expenses in accordance with:
72 (a) Section 63A-3-106;
73 (b) Section 63A-3-107; and
74 (c) rules made by the Division of Finance in accordance with Sections 63A-3-106 and
75 63A-3-107.
76 (6) The Housing and Community Development Division, described in Sections
77 35A-8-201 and 35A-8-202, shall provide staff support for the council.
78 (7) The council shall:
79 (a) focus on providing assistance to:
80 (i) very low and extremely low income renter households that earn 50% or less of the
81 area median income;
82 (ii) households that are paying more than half of their income for rent and utilities; and
83 (iii) households living in overcrowded or substandard housing;
84 (b) prepare a recommended annual allocation plan for grants to qualified applicants,
85 projects, or programs from federal Housing Trust Fund money made available to the state
86 under 12 U.S.C. Sec. 4568;
87 (c) submit the recommended annual allocation plan and any related recommendations
88 and policy guidelines to the Olene Walker Housing Loan Fund Board created in Section
89 35A-8-503;
90 (d) assist in the preparation and implementation of public participation plans and
91 requirements related to the allocation of federal Housing Trust Fund money;
92 (e) ensure coordination and compliance with state and federal requirements for the
93 federal Housing Trust Fund; and
94 (f) coordinate with the Olene Walker Housing Loan Fund Board to assess low income
95 housing needs in the state.
96 (8) The council shall prepare and submit, by October 1 of each year, an annual written
97 report of the council's activities, findings, and recommendations for inclusion in the annual
98 written report described in Section 35A-1-109.
