Chair Ipson called the meeting to order at 8:05 a.m.

MOTION:     Rep. Roberts moved to approve the minutes of the February 18, 2015 meeting. The motion passed unanimously with Rep. Peterson, Rep. Ray, and Rep. Romero absent for the vote.

H.B. 308         Search Warrant Amendments (Rep. V. L. Snow)

Rep. Snow explained the bill to the committee with the assistance of David Sonnenreich, Markets and Financial Fraud Division, Office of the Utah Attorney General.

MOTION:     Rep. Ray moved to replace H.B. 308 with 1st Substitute H.B. 308. The motion passed unanimously.

MOTION:     Rep. Peterson moved to pass 1st Substitute H.B. 308 out with a favorable recommendation. The motion passed unanimously.

H.B. 319         Jail Contracting Treatment Rate Amendments (Rep. M. Noel)

Rep. Noel explained the bill to the committee with the assistance of Sheriff Jim Tracy, President, Utah Sheriffs Association.

Spoke for the bill:       George Chapman, citizen

MOTION:     Rep. Roberts moved to pass H.B. 319 out with a favorable recommendation. The motion passed unanimously.

H.B. 300         Firearm and Dangerous Weapons Amendments (Rep. B. Greene)

Rep. Greene explained the bill to the committee. A handout "Salt Lake City v. Miles" was distributed to the committee.

Spoke for the bill:       Clark Aposhian, Utah Shooting Sports Council.

MOTION:     Rep. Roberts moved to amend the bill as follows:

1.    Page 1, Lines 11 through 12:   

11   This bill:

12   ►       {  redefines a  }  eliminates the definition of  concealed dangerous weapon {  to include only concealed firearms  } ;

2.    Page 3, Line 85 through Page 4, Line 91:     

85   (3) {  [  } (a) {  ]  } "Concealed [dangerous weapon"] firearm" means a [dangerous weapon]

86firearm that is:

87    {  [  } (i) {  ]  } {   (a)  } covered, hidden, or secreted in a manner that the public would not be aware of

88its presence; and

89    {  [  } (ii) {  ]  } {   (b)  } readily accessible for immediate use.

90   [(b) A dangerous weapon is not a concealed dangerous weapon if it is a firearm which

91is unloaded and is securely encased.]  (b) A firearm that is unloaded and securely encased is not a concealed firearm for the purposes of this part. 

The motion to amend passed unanimously.

MOTION:     Rep. Peterson moved to amend the bill as follows:

1.    Page 1, Line 23:  

23   76-10-504, as last amended by Laws of Utah 2013, Chapter 301

       76-10-507, as enacted by Laws of Utah 1973, Chapter 196  

2.    Page 7, Line 198:       

198 (b) upon the highways of the state as defined in Section 41-6a-102.

         Section 4. Section 76-10-507 is amended to read: 

       76-10-507.   Possession of deadly weapon with criminal intent.

       Every person having upon his person {  any  }  a  dangerous weapon with intent to {  unlawfully assault another  }  use it to commit a criminal offense  is guilty of a class A misdemeanor.

The motion to amend passed unanimously.

MOTION:     Rep. Ray moved to hold H.B. 300 in committee in order to review the changes with law enforcement.

SUBSTITUTE

MOTION:     Rep. Peterson moved to pass H.B. 300 out with a favorable recommendation. The motion passed with Rep. Daw, Rep. Hollins, Rep. Ray, and Rep. Romero voting in opposition.

MOTION:     Rep. Ray moved to adjourn the meeting. The motion passed unanimously.

Chair Ipson adjourned the meeting at 9:10 a.m.
