Chair Webb called the meeting to order at 3:55 p.m.

 

MOTION:       Rep. Miller moved to approve the minutes of the January 30, 2015, meeting. The motion passed unanimously with Rep. Anderson, Rep. Dunnigan, Rep. Pitcher, and Rep. Powell absent for the vote.

 

H.C.R. 3           Concurrent Resolution Recognizing the 100th Anniversary of the Settlement of Clarion, Utah (Rep. J. Cox)

 

Rep. Cox explained the resolution to the committee.

 

Vice Chair Powell assumed the chair.

 

MOTION:       Rep. Miller moved to pass H.C.R. 3 out favorably. The motion passed unanimously with Rep. Anderson and Rep. Dunnigan absent for the vote.

 

MOTION:       Rep. Miller moved to place H.C.R. 3 on the Consent Calendar. The motion passed unanimously with Rep. Anderson and Rep. Dunnigan absent for the vote.

 

 

 

H.B. 192           Property Rights Ombudsman Amendments (Rep. T. Hawkes)

 

Rep. Hawkes explained the bill to the committee.

MOTION:       Rep. Miller moved to pass H.B. 192 out favorably. The motion passed unanimously with Rep. Dunnigan and Rep. Ward absent for the vote.

 

MOTION:       Rep. Thurston moved to place H.B. 192 on the Consent Calendar. The motion passed unanimously with Rep. Anderson and Rep. Ward absent for the vote.

 

H.B. 190           Assessment Area Act Modifications (Rep. R. C. Webb)

 

Rep. Webb explained the bill to the committee and provided handouts pertaining to H.B. 190.

MOTION:       Rep. Ipson moved to replace H.B. 190 with 1st Substitute H.B. 190. The motion passed unanimously with Rep. Dunnigan, Rep. Pitcher, and Rep. Powell absent for the vote.

 

MOTION:       Rep. Anderson moved to amend the bill as follows:

 

1.    Page 17, Lines 496 through 499:          

 

496 (c) the benefitted property is conveyed to a subsequent purchaser and, before the date

497of conveyance, the requirements of Subsections 11-42-206(3)(a)(i) and (ii), or, if applicable,

498Subsection {  11-42-206(3)  }  11-42-207(1)(d)(i)  are met.

499 Section 5. Section 11-42-203 is amended to read:

 

The motion passed unanimously with Rep. Dunnigan, Rep. Pitcher, and Rep. Powell absent for the vote.

 

MOTION:       Rep. Webb moved to pass 1st Substitute H.B. 190 out favorably as amended.

 

SUBSTITUTE

MOTION:       Rep. Poulson moved to hold 1st Substitute H.B. 190. The substitute motion failed with Rep. Poulson voting in favor of the motion. Rep. Dunnigan, Rep. Pitcher, and Rep. Powell were absent for the vote.

 

The original motion passed unanimously with Rep. Dunnigan, Rep. Pitcher, and Rep. Powell absent for the vote.

H.B. 127           Local Land Use Amendments (Rep. J. Peterson)

 

Rep. Peterson explained the bill to the committee.

MOTION:       Rep. Ipson moved to replace H.B. 127 with 1st Substitute H.B. 127. The motion passed unanimously with Rep. Dunnigan, Rep. Miller, Rep. Pitcher, and Rep. Powell absent for the vote.

 

MOTION:       Rep. Anderson moved to pass 1st Substitute H.B. 127 out favorably. The motion passed unanimously with Rep. Dunnigan, Rep. Pitcher, and Rep. Powell absent for the vote.

 

MOTION:       Rep. Thurston moved to place 1st Substitute H.B. 127 on the Consent Calendar. The motion failed with Rep. Coleman and Rep. Miller voting in opposition. Rep. Dunnigan, Rep. Pitcher, and Rep. Powell were absent for the vote.

 

H.B. 228           Appellate Bond Amendments (Rep. D. Sagers)

 

Rep. Sagers explained the bill to the committee.

MOTION:       Rep. Anderson moved to pass H.B. 228 out favorably. The motion passed unanimously with Rep. Dunnigan, Rep. Kennedy, Rep. Pitcher, and Rep. Powell absent for the vote.

 

H.B. 61             Municipal Business Licensing Amendments (Rep. J. Anderegg)

 

This bill was tabled in the January 30, 2015, meeting. No motion was made to lift the bill from the table and so the bill was returned to the Rules Committee.

 

MOTION:       Rep. Anderson moved to adjourn. The motion passed unanimously with Rep. Dunnigan, Rep. Kennedy, Rep. Pitcher, and Rep. Powell absent for the vote.
