9 General Description:
10 This concurrent resolution of the Legislature and the Governor approves a site for new
11 state correctional facilities.
12 Highlighted Provisions:
13 This resolution:
14 ▸ recites the policy decision to move the state prison facilities currently located in
15 Draper to another location;
16 ▸ recites the history of the process of identifying a suitable site for new state
17 correctional facilities;
18 ▸ approves the site chosen by the Prison Relocation Commission as the site for the
19 development of new state correctional facilities;
20 ▸ directs the Division of Facilities Construction and Management to acquire property
21 at the site adequate for the development of new state correctional facilities; and
22 ▸ expresses the intent of the Legislature and Governor as to the redevelopment of the
23 former state prison property.

27 Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
28 WHEREAS, in 2014 the Legislature passed and the Governor signed H.C.R. 8,
29 Concurrent Resolution Regarding Moving the State Prison, in which the Legislature and
30 Governor concluded that "it is sound public policy and in the best interests of the state to move
31 the prison facilities from their current location in Draper" and that "the Utah State Prison
32 facilities currently located in Draper should be relocated from that site to one or more other
33 suitable locations in the state";
34 WHEREAS, in 2014 the Legislature and Governor created the Prison Relocation
35 Commission to "carefully and deliberately consider, study, and evaluate how and where to
36 move the state prison";
37 WHEREAS, the Prison Relocation Commission identified approximately 50 properties
38 offered by their owners as potential sites for new correctional facilities and, through a lengthy
39 and careful process, narrowed that list of potential sites to four;
40 WHEREAS, in legislation passed during the 2015 General Session, the Prison
41 Relocation Commission was directed to "choose the site for the construction of new prison
42 facilities from among the [four] sites that the commission recommended as potential sites" in
43 its February 27, 2015 report to the Legislature and Governor and to report the commission's
44 choice to the president of the Senate, the speaker of the House of Representatives, and the
45 Governor;
46 WHEREAS, that legislation also requires the state to pay all costs that are necessary
47 for, incidental to, or convenient to the development of the new correctional facilities;
48 WHEREAS, the Prison Relocation Commission has carefully and deliberately studied,
49 evaluated, and assessed the four sites and, through its team of consultants, subjected the four
50 properties to considerable technical study and evaluation for suitability for the construction of
51 new state correctional facilities;
52 WHEREAS, after due deliberation and consideration of all the available technical and
53 other information on the four sites under consideration, the Prison Relocation Commission has
54 determined that the site located near I-80 and 7200 West in Salt Lake City provides the best
55 long-term value to the state, has chosen that site as the site for the development of new state
56 correctional facilities, and has recommended that site to the Legislature and Governor; and
57 WHEREAS, the construction of new, state-of-the-art correctional facilities is vital to
58 the success of the Justice Reinvestment Initiative and the criminal justice system reforms
59 established by the passage H.B. 348, Criminal Justice Programs and Amendments, during the
60 2015 General Session:
61 NOW, THEREFORE, BE IT RESOLVED by the Legislature of the state of Utah, the
62 Governor concurring therein, that the site chosen by the Prison Relocation Commission near
63 I-80 and 7200 West in Salt Lake City be approved as the site for new state correctional
64 facilities to replace the correctional facilities currently located in the city of Draper.
65 BE IT FURTHER RESOLVED that the Division of Facilities Construction and
66 Management is directed to proceed, as provided by law, with the acquisition of the necessary
67 property at the chosen site for the construction of new state correctional facilities.
68 BE IT FURTHER RESOLVED that the Legislature and Governor express their intent
69 that, after the new correctional facilities are constructed and occupied, the former state prison
70 property in Draper be redeveloped in a way that produces optimal job growth and long-term
71 economic benefit and value to the state and minimizes the displacement of other development.
72 BE IT FURTHER RESOLVED that the Legislature and Governor express their intent
73 that the redevelopment of the former state prison property in Draper be done in strict
74 compliance with all ethics and conflict of interest provisions of the law applicable to legislators
75 and state employees.
76 BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Utah
77 Department of Corrections and the Division of Facilities Construction and Management.
