11 This bill addresses provisions relating to supplemental hours of instruction.
12 Highlighted Provisions:
13 This bill:
14 ▸ provides a local school board or charter school governing board with the authority
15 to offer supplemental hours of instruction to students enrolled in kindergarten
16 classes; and
17 ▸ enacts provisions relating to fees for supplemental hours of instruction.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 53A-3-402.7 is amended to read:
28 53A-3-402.7. Kindergartens -- Establishment -- Funding -- Supplemental hours
29 and associated fees.
30 (1) Kindergartens are an integral part of the state's public education system.
31 (2) (a) [
32 provide kindergarten classes free of charge for kindergarten children residing within the
33 district.

36 (3) (a) In addition to a kindergarten class described in Subsection (2), a local school
37 board or charter school governing board may offer supplemental hours of instruction to a
38 student enrolled in a kindergarten class.
39 (b) The supplemental hours described in Subsection (3)(a) are not part of the regular
40 school day.
41 (c) A local school board or charter school governing board that offers the supplemental
42 hours described in Subsection (3)(a):
43 (i) may charge a fee for the supplemental hours, in accordance with Chapter 12, Fees
44 and Textbooks, that does not exceed the actual cost of providing the supplemental hours to a
45 student; and
46 (ii) shall adopt a fee schedule for the supplemental hours, in accordance with Section
47 53A-12-103, that ensures that no student is denied the opportunity to participate in the
48 supplemental hours because of an inability to pay the fee.
