8     General Description:
9          This bill distinguishes an early college high school from a regular public school.
10     Highlighted Provisions:
11          This bill:
12          ▸     defines terms;
13          ▸     exempts an early college high school from certain rules established by the State
14     Board of Education; and
15          ▸     restricts the use of the term "early college high school."

26     Be it enacted by the Legislature of the state of Utah:
27          Section 1. Section 53A-1a-1101 is enacted to read:
28     
Part 11. Early College High Schools

29          53A-1a-1101. Title.
30          This part is known as "Early College High Schools."
31          Section 2. Section 53A-1a-1102 is enacted to read:
32          53A-1a-1102. Definitions.
33          (1) "Board" means the State Board of Education.
34          (2) "Individualized Education Program" or "IEP" means a written statement, for a
35     student with a disability, that is developed, reviewed, and revised in accordance with the
36     Individuals with Disabilities Education Act, 20 U.S.C. Sec. 1400 et seq.
37          Section 3. Section 53A-1a-1103 is enacted to read:
38          53A-1a-1103. Early college high schools -- Exemptions from board rule --
39     Prohibitions.
40          (1) An early college high school is a public school that:
41          (a) has a mission to provide an early college education to a diverse student population
42     emphasizing advanced science, technology, engineering, and mathematics;
43          (b) provides students with the opportunity to earn:
44          (i) a high school diploma; and
45          (ii) (A) at least 60 credit hours of transferable college credit; or
46          (B) a transferable associate's degree; and
47          (c) contracts with an institution of higher education for instruction offered through the
48     public school.
49          (2) (a) An early college high school is exempt from the required number of school days
50     established under board rule.
51          (b) Notwithstanding the exemption described in Subsection (2)(a), an early college
52     high school is subject to the required number of instructional hours established under board
53     rule.
54          (3) Up to three of the subject-specific credit hour graduation requirements established
55     under board rule may be changed to elective credit for a student at an early college high school
56     if:

57          (a) the modification is consistent with the student's:
58          (i) IEP; or
59          (ii) student education occupation plan; and
60          (b) the elective credit is earned in a science, technology, engineering, mathematics,
61     advanced placement, concurrent enrollment, or early college course.
62          (4) A public school may not identify or market the public school as an early college
63     high school unless the public school meets the criteria described in Subsection (1).
