7     LONG TITLE
8     General Description:
9          This bill modifies the Division of Occupational and Professional Licensing Act.
10     Highlighted Provisions:
11          This bill:
12          ▸     allows an applicant for licensure under Title 58, Occupations and Professions, to
13     receive a deferral of fees, under certain circumstances, if the applicant agrees to pay
14     the fees within six months of receiving a license; and
15          ▸     provides a sunset date.

27     Be it enacted by the Legislature of the state of Utah:

28          Section 1. Section 58-1-301.3 is enacted to read:
29          58-1-301.3. Waiver of licensing fees.
30          (1) An individual applicant for licensure under this title who is unable to pay the fees
31     described in Subsection 58-1-301(1) may apply for licensure with deferred payment of the fees
32     if the applicant provides evidence to the division that the applicant is receiving public
33     assistance administered by the Department of Workforce Services.
34          (2) If the applicant provides the evidence described in Subsection (1), the division shall
35     defer payment of the fees of an applicant for licensure under this title, if the applicant agrees to
36     pay the fees within six months of receiving a license.
37          (3) If an applicant receives a license under this section and fails to pay the fees within
38     six months of receiving the license, the license shall be suspended.
39          (4) If an applicant's license is suspended under Subsection (3), the applicant may not be
40     licensed in good standing until the applicant meets all the requirements for licensure and pays
41     the applicable fees.
42          Section 2. Section 63I-1-258 is amended to read:
43          63I-1-258. Repeal dates, Title 58.
44          (1) Section 58-1-301.3 is repealed July 1, 2021.
45          [(1)] (2) Title 58, Chapter 13, Health Care Providers Immunity from Liability Act, is
46     repealed July 1, 2026.
47          [(2)] (3) Title 58, Chapter 15, Health Facility Administrator Act, is repealed July 1,
48     2025.
49          [(3)] (4) Title 58, Chapter 20a, Environmental Health Scientist Act, is repealed July 1,
50     2018.
51          [(4)] (5) Section 58-37-4.3 is repealed July 1, 2016.
52          [(5)] (6) Title 58, Chapter 40, Recreational Therapy Practice Act, is repealed July 1,
53     2023.
54          [(6)] (7) Title 58, Chapter 41, Speech-Language Pathology and Audiology Licensing
55     Act, is repealed July 1, 2019.
56          [(7)] (8) Title 58, Chapter 42a, Occupational Therapy Practice Act, is repealed July 1,
57     2025.
58          [(8)] (9) Title 58, Chapter 46a, Hearing Instrument Specialist Licensing Act, is

59     repealed July 1, 2023.
60          [(9)] (10) Title 58, Chapter 47b, Massage Therapy Practice Act, is repealed July 1,
61     2024.
62          [(10)] (11) Title 58, Chapter 61, Part 7, Behavior Analyst Licensing Act, is repealed
63     July 1, 2026.
64          [(11)] (12) Title 58, Chapter 72, Acupuncture Licensing Act, is repealed July 1, 2017.
