7     LONG TITLE
8     General Description:
9          This bill amends a provision related to legal notice by publication in a newspaper of
10     general circulation.
11     Highlighted Provisions:
12          This bill:
13          ▸     modifies the criteria for a publication to be considered a newspaper of general
14     circulation for the purpose of legal notice.

23     Be it enacted by the Legislature of the state of Utah:
24          Section 1. Section 45-1-201 is amended to read:
25          45-1-201. Newspapers "of general circulation" -- Requirements.
26          [No newspaper shall be deemed a newspaper having general circulation for the purpose
27     of publishing any notice, advertisement or publication of any kind required by law, unless it

28     has]
29          For the purpose of publishing notice required by Utah law, a "newspaper of general
30     circulation" means a newspaper that:
31          (1) has a bona fide subscription list of not less than 200 subscribers in this state[, and
32     shall have];
33          (2) has been published for [not less than] 18 months[, and shall have been admitted in
34     the] or longer; and
35          (3) has been eligible for mailing under United States [mails as second-class matter]
36     Postal Rules and Regulations for at least 12 months[; provided, that nothing in this chapter
37     shall invalidate the publication in a newspaper which has simply changed its name or
38     ownership, or has simply moved its place of publication from one part of the state to another,
39     or suspended publication on account of fire, flood or unavoidable accident not to exceed 10
40     weeks; provided further, that nothing in this chapter shall apply to any county wherein no
41     newspaper has been published the requisite length of time].
