7     LONG TITLE
8     General Description:
9           This bill enacts reporting provisions regarding refiners' compliance with certain federal
10     gasoline sulfur standards.
11     Highlighted Provisions:
12          This bill:
13          ▸      provides definitions;
14          ▸     enacts a reporting provision for certain refiners of gasoline regarding compliance
15     with certain federal gasoline sulfur standards;
16          ▸     requires the Division of Air Quality to report certain information to an interim
17     committee of the Legislature; and
18          ▸     provides a sunset date for the reporting provisions.

30     Be it enacted by the Legislature of the state of Utah:
31          Section 1. Section 19-12-401 is enacted to read:
32     
Part 4. Refiner Gasoline Sulfur Standard Reporting Act

33          19-12-401. Definitions.
34          As used in this section:
35          (1) "Blending stock," "blendstock," or "component" means any liquid compound that is
36     blended with other liquid compounds to produce gasoline.
37          (2) "Refiner" means any person who owns, leases, operates, controls, or supervises a
38     refinery.
39          (3) "Refinery" means a facility where gasoline or diesel fuel is produced, including a
40     facility at which blendstocks are combined to produce gasoline or diesel fuel, or at which
41     blendstock is added to gasoline or diesel fuel.
42          Section 2. Section 19-12-402 is enacted to read:
43          19-12-402. Refiner gasoline standard reporting -- Division of Air Quality
44     reporting.
45          (1) The Legislature recognizes that:
46          (a) the state's air quality is a matter of statewide concern; and
47          (b) it is in the state's interest to seek ways to improve air quality and reduce the harmful
48     effects of vehicle emissions within the state.
49          (2) (a) The Division of Air Quality shall request a refiner or a refiner's designated agent
50     or representative to annually report to the Division of Air Quality on or before October 31
51     regarding:
52          (i) the refiner's plans to implement the United States Environmental Protection
53     Agency's Tier 3 gasoline sulfur standard described in 40 C.F.R. Sec. 80.1603; and
54          (ii) whether the refiner's facility that is located within the state will have an average
55     gasoline sulfur level of 10 parts per million (ppm) using the formulas prescribed in 40 C.F.R.
56     Sec. 80.1603, excluding the offset for credit use and transfer as prescribed in 40 C.F.R. Sec.

57     80.1616.
58          (b) Fuels that are not subject to the standards and requirements of 40 C.F.R. Sec.
59     80.1603 as specified in 40 C.F.R. Sec. 1601 are not subject to the reporting provisions under
60     Subsection (2)(a).
61          (3) The Division of Air Quality shall annually report on or before November 30 to the
62     Natural Resources, Agriculture, and Environment Interim Committee on the reports collected
63     under Subsection (2).
64          Section 3. Section 63I-1-219 is amended to read:
65          63I-1-219. Repeal dates, Title 19.
66          (1) Title 19, Chapter 2, Air Conservation Act, is repealed July 1, 2019.
67          (2) Title 19, Chapter 4, Safe Drinking Water Act, is repealed July 1, 2019.
68          (3) Title 19, Chapter 5, Water Quality Act, is repealed July 1, 2019.
69          (4) Title 19, Chapter 6, Part 1, Solid and Hazardous Waste Act, is repealed July 1,
70     2019.
71          (5) Title 19, Chapter 6, Part 3, Hazardous Substances Mitigation Act, is repealed July
72     1, 2020.
73          (6) Title 19, Chapter 6, Part 4, Underground Storage Tank Act, is repealed July 1,
74     2018.
75          (7) Title 19, Chapter 6, Part 6, Lead Acid Battery Disposal, is repealed July 1, 2016.
76          (8) Title 19, Chapter 6, Part 7, Used Oil Management Act, is repealed July 1, 2019.
77          (9) Title 19, Chapter 6, Part 8, Waste Tire Recycling Act, is repealed July 1, 2020.
78          (10) Title 19, Chapter 6, Part 10, Mercury Switch Removal Act, is repealed July 1,
79     2017.
80          (11) Title 19, Chapter 12, Part 4, Refiner Gasoline Sulfur Standard Reporting Act, is
81     repealed July 1, 2021.
