9 General Description:
10 This bill authorizes the State Board of Regents to execute an interstate reciprocity
11 agreement regarding postsecondary distance education.
12 Highlighted Provisions:
13 This bill:
14 ▸ authorizes the State Board of Regents to execute an interstate reciprocity agreement
15 regarding interstate offering of postsecondary distance education courses and
16 programs; and
17 ▸ grants rulemaking authority.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 53B-16-109 is enacted to read:
28 53B-16-109. Interstate reciprocity agreement regarding postsecondary distance
29 education courses.
30 (1) As used in this section:
31 (a) "Distance education" means instruction offered by a means where the student and
32 faculty member are in separate physical locations.
33 (b) "Institution" means a degree-granting postsecondary education entity.
34 (c) "Postsecondary education" means education or educational services offered
35 primarily to an individual who:
36 (i) has completed or terminated the individual's secondary or high school education; or
37 (ii) is beyond the age of compulsory school attendance.
38 (2) The board may execute an interstate reciprocity agreement for postsecondary
39 distance education:
40 (a) for an institution that offers a postsecondary distance education course or program;
41 and
42 (b) that requires an institution to meet certain standards to become authorized to
43 operate under the interstate reciprocity agreement.
44 (3) If the board executes an interstate reciprocity agreement under Subsection (2), the
45 board shall make rules, in accordance with Title 63G, Chapter 3, Utah Administrative
46 Rulemaking Act, to establish:
47 (a) standards for granting an institution authorization to operate under the interstate
48 reciprocity agreement;
49 (b) a filing, document, or membership fee required for an institution to obtain
50 authorization under the interstate reciprocity agreement; and
51 (c) a process for administering the interstate reciprocity agreement.
