8     LONG TITLE
9     General Description:
10          This joint resolution of the Legislature proposes to amend the Utah Constitution to
11     establish a right relating to growing or acquiring food.
12     Highlighted Provisions:
13          This resolution:
14          ▸     provide for an individual right of the people to grow food for their own
15     consumption or to acquire food from its source.
16     Special Clauses:
17          This resolution directs the lieutenant governor to submit this proposal to voters.
18          This resolution provides a contingent effective date of January 1, 2017, for this
19     proposal.

21     ENACTS:
22          ARTICLE I, SECTION 30

24     Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each
25     of the two houses voting in favor thereof:

26          Section 1. It is proposed to enact Utah Constitution Article I, Section 30, to read:
27          Article I, Section 30. [Right to food.]
28          (1) The individual right of the people to grow food for their own consumption or to
29     acquire food directly from a source of their own choosing may not be infringed.
30          (2) Nothing in Subsection (1) prevents the Legislature from providing by statute for the
31     regulation of the production, processing, and distribution of food for retail, restaurant, or
32     commercial use.
33          Section 2. Submittal to voters.
34          The lieutenant governor is directed to submit this proposed amendment to the voters of
35     the state at the next regular general election in the manner provided by law.
36          Section 3. Contingent effective date.
37          If the amendment proposed by this joint resolution is approved by a majority of those
38     voting on it at the next regular general election, the amendment shall take effect on January 1,
39     2017.
