7     LONG TITLE
8     General Description:
9           This bill enacts language related to an instructor for the Junior Reserve Officer's
10     Training Corps.
11     Highlighted Provisions:
12          This bill:
13          ▸      exempts a Junior Reserve Officer's Training Corps instructor from holding an
14     educator license; and
15          ▸     requires a Junior Reserve Officer's Training Corps instructor to submit to a
16     background check.

25     Be it enacted by the Legislature of the state of Utah:
26          Section 1. Section 53A-6-114 is enacted to read:
27          53A-6-114. JROTC instructors.
28          (1) As used in this section:
29          (a) "Junior Reserve Officer's Training Corps instructor" or "JROTC instructor" means

30     an individual who:
31          (i) provides instruction authorized by 10 U.S.C. Sec. 2031; and
32          (ii) is qualified to provide instruction in accordance with 10 U.S.C. Sec. 2033.
33          (b) "Junior Reserve Officer's Training Corps program" or "JROTC program" means a
34     program established in a school district or charter school as described in 10 U.S.C. Sec. 2031.
35          (2) A school district, a charter school, or the board may not require that a JROTC
36     instructor hold a license as described in this part to teach a course that is part of a JROTC
37     program.
38          (3) A JROTC instructor shall submit to a background check under Section
39     53A-15-1503 as a condition for employment in a school district or charter school.
