7     LONG TITLE
8     General Description:
9           This bill amends provisions related to discrimination.
10     Highlighted Provisions:
11          This bill:
12          ▸      prohibits discrimination against an individual because of pregnancy or lactation; and
13          ▸     makes technical corrections.

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 13-7-2 is amended to read:
24          13-7-2. Definitions.
25           As used in this chapter:
26          [(3)] (1) "Enterprises regulated by the state" means:
27          (a) an institution subject to regulation under Title 70C, Utah Consumer Credit Code;

28          (b) a place of business that sells an alcoholic product at retail as provided in Title 32B,
29     Alcoholic Beverage Control Act;
30          (c) an insurer regulated by Title 31A, Insurance Code; and
31          (d) a public utility subject to regulation under Title 54, Public Utilities.
32          (2) "Person" includes one or more individuals, partnerships, associations, organizations,
33     corporations, labor unions, legal representatives, trustees, trustees in bankruptcy, receivers, and
34     other organized groups of persons.
35          [(1)] (3) (a) "Place of public accommodation" includes every place, establishment, or
36     facility of whatever kind, nature, or class that caters or offers its services, facilities, or goods to
37     the general public for a fee or charge, except, an establishment that is:
38          (i) located within a building that contains not more than five rooms for rent or hire; and
39          (ii) actually occupied by the proprietor of the establishment as the proprietor's
40     residence.
41          (b) [A] "Place of public accommodation" includes a place, establishment, or facility
42     that caters or offers its services, facilities, or goods to the general public gratuitously [shall be
43     within the definition of this term if it] if the place, establishment, or facility receives any
44     substantial governmental subsidy or support.
45          (c) "Place of public accommodation" does not [apply to any] include an institution,
46     church, [any] apartment house, club, or place of accommodation [which is in its nature] that is
47     distinctly private, except to the extent that [it] the institution, church, apartment house, club, or
48     place of accommodation is open to the public.
49          (4) "Sex" includes pregnancy and lactation.
