7     LONG TITLE
8     General Description:
9          This bill modifies provisions of the Building Inspector and Factory Built Housing
10     Licensing Act.
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms;
14          ▸     creates an optional approved inspector apprenticeship for individuals training to
15     become licensed building inspectors;
16          ▸     describes the requirements of an approved inspector apprenticeship;
17          ▸     grants rulemaking authority to the division regarding:
18               •     an approved inspector apprenticeship; and
19               •     requirements for registering as an inspector apprentice; and
20          ▸     makes technical changes.

32     Be it enacted by the Legislature of the state of Utah:
33          Section 1. Section 58-56-3 is amended to read:
34          58-56-3. Definitions.
35          (1) In addition to the definitions in Section 58-1-102, definitions in the following
36     sections apply to this chapter:
37          [(1)] (a) Section 15A-1-102;
38          [(2)] (b) Section 15A-1-202; and
39          [(3)] (c) Section 15A-1-302.
40          (2) As used in this chapter:
41          (a) "Approved inspector apprenticeship" means an optional apprenticeship that is
42     designed to train an individual to obtain licensure under this chapter and that meets the
43     requirements:
44          (i) of Section 58-56-9.6; and
45          (ii) established by rule by the division in collaboration with the board in accordance
46     with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
47          (b) "Combination inspector" means a combination inspector licensed under this chapter
48     and rules established by the division in collaboration with the board in accordance with Title
49     63G, Chapter 3, Utah Administrative Rulemaking Act, to inspect the components of any
50     building, structure, or work for which a standard is provided in the edition of the state
51     construction codes most recently adopted under Title 15A, State Construction and Fire Codes
52     Act.
53          (c) "Registered inspector apprentice" is an apprentice in an approved inspector
54     apprenticeship who has registered with the division in accordance with Section 58-56-9.6.
55          Section 2. Section 58-56-9.6 is enacted to read:
56          58-56-9.6. Apprenticeship.
57          (1) An approved inspector apprenticeship shall:
58          (a) consist of not less than 200 hours of training;

59          (b) be conducted by a supervisor who:
60          (i) is a combination inspector; and
61          (ii) provides one-on-one direct supervision of the apprentice during the apprenticeship;
62     and
63          (c) be in accordance with rules made by the division in collaboration with the board in
64     accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
65          (2) A person seeking to qualify for licensure by apprenticing in an approved
66     apprenticeship under this chapter shall:
67          (a) register with the division before beginning the apprenticeship by:
68          (i) submitting a form prescribed by the division, which includes the name of the
69     licensed supervisor; and
70          (ii) paying a fee determined by the department under Section 63J-1-504; and
71          (b) complete the apprenticeship and the requirements for licensure under this chapter
72     within one year of the date on which the division approves the registration.
73          Section 3. Section 58-56-9.7 is enacted to read:
74          58-56-9.7. Exemptions from licensure.
75          In addition to the exemptions from licensure in Section 58-1-307, a registered inspector
76     apprentice may act as a building inspector if the registered inspector apprentice is under the
77     direct supervision of a supervisor as described in Section 58-56-9.6 and is acting in accordance
78     with rules made by the division in collaboration with the board in accordance with Title 63G,
79     Chapter 3, Utah Administrative Rulemaking Act.
