8     LONG TITLE
9     General Description:
10          This concurrent resolution of the Legislature and the Governor approves the land
11     exchange proposed by S.2383 - Utah Test and Training Range Encroachment
12     Prevention and Temporary Closure Act.
13     Highlighted Provisions:
14          This resolution:
15          ▸     approves the proposed exchange of school and institutional trust lands and mineral
16     interests in Box Elder, Tooele, Juab, and Washington counties for United States
17     government lands in Box Elder, Tooele, Juab, Millard, and Beaver counties; and
18          ▸     recognizes that the land received by the state in the exchange would provide greater
19     economic development potential, and be better managed and administered for the
20     benefit of the state's trust land beneficiaries and economy.
21     Special Clauses:
22          None

24     Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
25          WHEREAS, introduced federal legislation, S.2383 - Utah Test and Training Range
26     Encroachment Prevention and Temporary Closure Act, proposes to withdraw certain Bureau of
27     Land Management land in the state of Utah from public appropriation in order to facilitate

28     enhanced weapons testing and pilot training in connection with the Utah Test and Training
29     Range, and also provide for the exchange of certain federal lands and state school trust lands
30     managed by the School and Institutional Trust Lands Administration (SITLA);
31          WHEREAS, the Legislature received the proposal for the land exchange;
32          WHEREAS, Subsection 63L-2-101(2) of the Utah Code requires legislative approval
33     before a state agency may legally bind the state by executing an agreement to sell or transfer to
34     the United States government 10,000 or more acres of any state lands or school and
35     institutional trust lands;
36          WHEREAS, the proposed withdrawal area, together with the existing Dugway Proving
37     Ground, includes approximately 68,057 acres of state school trust lands, together with 10,280
38     acres of state school trust severed mineral interests;
39          WHEREAS, the adjacent Cedar Mountains Wilderness contains an additional 2,353
40     acres of state school trust lands and 3,560 acres of state school trust severed mineral interests;
41          WHEREAS, S.2383, if enacted, will authorize SITLA to exchange the state school trust
42     lands and severed mineral interests described above for approximately 99,000 acres of federal
43     lands and mineral interests;
44          WHEREAS, S.2383 also provides for SITLA to convey to the Bureau of Land
45     Management certain conservation lands in Washington County, if necessary, to ensure that the
46     values of federal and state lands committed to the exchange are equal; and
47          WHEREAS, the land exchange authorized by S.2383 would exchange school trust
48     lands that are currently scattered in small parcels for lands with greater economic development
49     potential that could be more efficiently managed and administered for the benefit of the state's
50     trust lands beneficiaries and economy as a whole:
51          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the
52     Governor concurring therein, approves the land exchange between the state of Utah and the
53     United States government, as proposed by S.2383.
