H.B. 329         Federal Funds Procedures Act Amendments (Rep. J. Fawson)


Rep. Fawson explained the bill with the assistance of Ms. Jennifer Johnson, 2nd Vice Chair, Utah State Board of Education. Ms. Johnson reviewed a slide presentation.


MOTION:     Rep. Eliason moved to replace H.B. 329 with 1st Sub. H.B. 329. The motion passed unanimously with Rep. Christensen, Rep. Gibson, Rep. Lifferth, Rep. McCay, Rep. Moss, and Rep. Noel absent for the vote.


MOTION:     Rep. Snow moved to amend the bill as follows:

 

1.    Page 3, Lines 81 through 84:   

 

81   (e) "Federal maintenance of effort requirements" means any matching, level of effort,

82or earmarking requirements, as defined in Office of Management and Budget {  Circular A-133,

83Compliance Requirement G  }  requirements  , that are imposed on an agency as a condition of receiving federal

84funds.

 

The motion passed unanimously with Rep. Christensen, Rep. Gibson, Rep. Lifferth, Rep. Moss, and Rep. Noel absent for the vote.

H.B. 71           Weighted Pupil Unit Calculation Equalization Amendments (Rep. B. R. Cutler)

 

Rep. Cutler explained the bill with the assistance of Mr. Brad Nelson, Spectrum Academy.

 

MOTION:     Rep. Cutler moved to amend the bill as follows:

 

1.    Page 3, Lines 71 through 80:   

 

71   (3) (a) Except as provided in Subsections (3)(b) and (3)(c), a charter school shall

72receive state funds, as applicable, on the same basis as a school district receives funds.

73   (b)  (i)  [For the 2015-16 school year, the] The number of weighted pupil units assigned to

74a charter school for the kindergarten and grades 1 through 12 programs of the Basic School

75Program shall be:

76    {  (i)  }  (A)  [based on the higher of: (A) October 1 enrollment in the current school year; or (B)]

77  except as provided in Subsection (3)(b)(ii),   average daily membership in the prior school year plus growth as determined under Section

7853A-17a-106; and

79    {  (ii)  }  (B)  weighted as provided in Subsection (3)(c).

         (ii) The number of weighted pupil units assigned to a charter school as described in Subsection (3)(b)(i) may be based on October 1 enrollment of the current school year if:

       (A) the charter school's charter agreement states that the charter school's student population is composed of no less than 75% of students with special needs who have an individualized education program developed in accordance with the Individuals with Disabilities Education Improvement Act of 2004; and

       (B) the governing board of the charter school described in Subsection (3)(b)(ii)(A) requests that the weighted pupil units be based on October 1 enrollment and the State Board of Education approves the request.  

80   (c) In distributing funds under Chapter 17a, Minimum School Program Act, to charter

H.B. 312         Peer Assistance and Review Program Amendments (Rep. J. Briscoe)

 

Rep. Briscoe explained the bill with the assistance of Mr. Logan Hall, Salt Lake City School District, and distributed "HB 312, Peer Assistance and Review Program Amendments."

H.B. 343         School Administration Amendments (Rep. K. Stratton)

 

Rep. Stratton explained the bill with the assistance of Ms. Paula Plant, Utah State Office of Education.

S.B. 72            School and Institutional Trust Lands Management Act Amendments (Sen. M. Dayton) (Rep. M. McKell)

 

S.B. 72 was not considered.

 

H.C.R. 12       Concurrent Resolution Honoring Lin-manuel Miranda, Composer of the Musical Hamilton (Rep. K. Ivory)

 

Chair Last introduced Mr. Ethan Bastian, Junior, Copper Hills High School, and Mr. Noah Coleman, Sophomore, Copper Hills High School, and invited them to perform a synopsis from the musical "Hamilton."

 

Rep. Ivory explained the resolution with the assistance of Speaker Greg Hughes.

 

MOTION:     Rep. Eliason moved to replace H.C.R. 12 with 1st Sub. H.C.R 12. The motion passed unanimously with Rep. McCay absent for the vote.

 

MOTION:     Rep. Cutler moved to pass the resolution out favorably. The motion passed unanimously with Rep. McCay absent for the vote.
