Chair McIff called the meeting to order at 2:10 p.m.

 

H.B. 93           Organ Donor Amendments (Rep. G. Froerer)

 

MOTION:     Rep. Hall moved to amend H.B. 93 as follows:


 

1.    Page 1, Lines 14 through 16:   

 

14         requires an institution of higher education to {  display  }  distribute by electronic message  certain information {  on the

15institution's website  } regarding organ donation.

16Money Appropriated in this Bill:

 

2.    Page 2, Lines 30 through 49:   

 

30   (c) "Institution of higher education" means an institution as described in Section

3153B-3-102.

32    {  (2) (a) An institution of higher education shall display, in accordance with Subsection

33(2)(b):

34   (i) text notifying a student of the option to register as a donor by selecting the Internet

35link described in Subsection (2)(a)(ii); and

36   (ii) an Internet link to a website for a donor registry established under Section

3726-28-120.

38   (b) Except as provided in Subsection (2)(c), an institution of higher education shall

39display the information described in Subsections (2)(a)(i) and (ii) as a pop-up window on:

40   (i) an institutional web page on which a student registers for a course at least once

41during the academic year; or

42   (ii) at least once each semester, quarter, or other applicable division of an academic

43year, a secure Internet site that is customized for a student to access the individual student's

44academic and other information.

45   (c) (i) An institution of higher education may provide the information described in

46Subsections (2)(a)(i) and (ii) by other electronic means if the institution does not offer

47Internet-based course registration or maintain a secure Internet site.

48   (ii) An institution of higher education described in Subsection (2)(c)(i) shall provide

49the information by other electronic means at least twice per school year.  }

          (2)(a) An institution of higher education shall distribute, twice each academic year to each enrolled student:

       (i) an electronic message notifying each student of the option to register as a donor by selecting the Internet link described in Subsection (2)(a)(ii); and

       (ii) through the electronic message described in Subseciton (2)(a)(i) an Internet link to a website for a donor registry established under Section 26-28-120.

       (b) An institution of higher education may also provide to students information on donor registry by other electronic, printed, or in-person means.

    

 

The motion passed unanimously with Rep. Brown, Rep. Kennedy, and Rep. Ray absent for the vote.

 

Rep. Froerer explained H.B. 93 to the committee with the assistance of Mr. Alex McDonald, representing Intermountain Donor Services. A handout was provided.

MOTION:     Rep. Thurston moved to pass H.B. 93 out favorably, as amended. The motion passed unanimously, with Rep. Ray absent for the vote.

 

H.B. 150         Controlled Substance Prescription Notification (Rep. B. Daw)

 

MOTION:     Rep. Ward moved to amend H. B. 150 as follows:

 

3.    Page 1, Line 15:  

 

15when a controlled substance prescription is dispensed to the person;  

       ► allows the person to direct the division to discontinue providing the information;

       ► requires that the division comply with the direction and also notify the third party of the discontinuation;   and

 

4.    Page 9, Line 246:       

 

246 (ii) the date the controlled substance was dispensed.

       (c) (i) An individual who has made a request under Subsection (5)(a) may direct that the division discontinue providing information to the third party.

       (ii) The division shall:

       (A) notify the third party that the individual has directed the division to no longer provide information to the third party; and

       (B) discontinue providing information to the third party. 

 

The motion passed unanimously with Rep. Ray absent for the vote.

MOTION:     Rep. Ward moved to pass H.B. 150 out favorably as amended. The motion passed unanimously with Rep. Barlow absent for the vote.

 

MOTION:     Rep. Brown moved to adjourn the meeting. The motion passed unanimously, with Rep. Barlow absent for the vote.
