7     LONG TITLE
8     General Description:
9          This bill creates the Local Food Advisory Council.
10     Highlighted Provisions:
11          This bill:
12          ▸     creates the Local Food Advisory Council;
13          ▸     designates the duties of the council; and
14          ▸     requires the council to periodically report to the Natural Resources, Agriculture, and
15     Environment Interim Committee and the Department of Agriculture and Food.
16     Money Appropriated in this Bill:
17          This bill appropriates:
18          ▸     to the Senate, as an ongoing appropriation:
19               •     from the General Fund, $2,000 to pay for the council; and
20          ▸     to the House of Representatives, as an ongoing appropriation:
21               •     from the General Fund, $4,000 to pay for the council.
22     Other Special Clauses:
23          This bill provides a repeal date.

27     Be it enacted by the Legislature of the state of Utah:
28          Section 1. Local Food Advisory Council Created.

29          (1) There is created the Local Food Advisory Council consisting of up to the following
30     13 members:
31          (a) one member of the Senate appointed by the president of the Senate;
32          (b) two members of the House of Representatives appointed by the speaker of the
33     House of Representatives, each from a different political party;
34          (c) the commissioner of the Department of Agriculture and Food, or the
35     commissioner's designee;
36          (d) the executive director of the Department of Health, or the executive director's
37     designee;
38          (e) two crop direct-to-consumer food producers, appointed by the governor;
39          (f) two animal direct-to-consumer food producers, appointed by the governor; and
40          (g) the following potential members, appointed by the governor as needed:
41          (i) a direct-to-consumer food producer;
42          (ii) a member of a local agriculture organization;
43          (iii) a food retailer;
44          (iv) a licensed dietician;
45          (v) a county health department representative;
46          (vi) an urban farming representative;
47          (vii) a representative of a business engaged in the processing, packaging, or
48     distribution of food;
49          (viii) an anti-hunger advocate; and
50          (ix) an academic with expertise in agriculture.
51          (2) (a) The president of the Senate shall designate a member of the Senate appointed
52     under Subsection (1)(a) as a cochair of the commission.
53          (b) The speaker of the House of Representatives shall designate a member of the House
54     of Representatives appointed under Subsection (1)(b) as a cochair of the commission.
55          (3) In appointing members to the council under Subsections (1)(e) through (g), the

56     governor shall strive to take into account the geographical makeup of the council.
57          (4) A vacancy on the council resulting from the council shall be filled in the same
58     manner in which the original appointment was made.
59          (5) Compensation for a member of the council who is a legislator shall be paid in
60     accordance with Section 36-2-2 and Legislative Joint Rules, Title 5, Chapter 3, Legislator
61     Compensation.
62          (6) Council members who are employees of the state shall receive no additional
63     compensation.
64          (7) The Department of Agriculture and Food shall provide staff support for the council.
65          Section 2. Duties.
66          (1) The council shall study and make recommendations on:
67          (a) how to best promote vibrant, locally owned farms;
68          (b) how to best promote resilient ecosystems;
69          (c) how to best promote strong communities and healthy eating;
70          (d) how to best enhance thriving local food economies;
71          (e) how best to assess impacts of population growth and urbanization and the decline in
72     productive ranch and farmland;
73          (f) assessment of laws and regulations that deter or hinder the direct sales of locally
74     grown and produced food; and
75          (g) necessary steps to develop and implement a robust, integrated local food system.
76          (2) It is the purpose of the Local Food Advisory Council to contribute to:
77          (a) building a local food economy;
78          (b) benefitting the state by creating jobs;
79          (c) stimulating statewide economic development;
80          (d) circulating money from local food sales within local communities;
81          (e) preserving open space;
82          (f) fostering the viability of family-owned farms;

83          (g) preserving and protecting the natural environment;
84          (h) increasing consumer access to fresh and nutritious food; and
85          (i) providing greater food security for state residents.
86          Section 3. Duties -- Interim report.
87          (1) The council shall:
88          (a) convene at least four times each year; and
89          (b) review and make recommendations regarding the policy issues listed in Section 2.
90          (2) The council shall prepare an annual report and present the report before November
91     30, 2017, and every November thereafter to:
92          (a) the Natural Resources, Agriculture, and Environment Interim Committee;
93          (b) the Department of Agriculture and Food; and
94          (c) the Food Advisory Board.
95          Section 4. Appropriation.
96           The following sums of money are appropriated for the fiscal year beginning July 1,
97     2017, and ending June 30, 2018. These are additions to amounts previously appropriated for
98     fiscal year 2018. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
99     Act, the Legislature appropriates the following sums of money from the funds or accounts
100     indicated for the use and support of the government of the state of Utah.
